[Recites: (A) Mortgage (Lease and Release) in trust, for £5,250, dated 29, 30 Mar. 1692: (i) John, Lord Stawell, Baron of Somerton, since decd.; (ii) James Ward, esq., and Edw. Herris, merchant, both of London; and (iii) Saml. Browne, gent., since decd., and William Morris, gent., both of London:
The manor of Babcary with appurts. [no details].
To hold to (iii) in trust for (ii) for ever, on proviso for making void on payment by (i) to (ii) of £5,250, which was not, in fact, repaid.
(B) Conveyance (Lease and Release) for £1834 16s. dated 7, 8 Mar. 1697/8: (i) sd. William Morris, James Ward and Edw. Herris; (ii) Hon. Robt. Cecill, esq., brother of James, Earl of Salisbury, decd., Sir John Austen of Stagerdown in Paul's Walden (co. Herts.), bart., since decd., Edw. Berkeley of Pylle, esq., John Hunt of Compton Pauncefoot, esq., and Jerrard Newcourt of Ivythorn, gent. (Trustees under Act of 5 & 6 Wm. and Mary for payment of debts of sd. John, Lord Stawell); and (iii) the sd. Francis Bennett:

In consideration of £104 13s. 4d., the sum mentioned to be the consideration paid by Edw. Colley in Indenture tripartite of even date:
(i) Frances Sherwood of Somerton, widow and execs. of Will of Ralph S.;
(ii) sd. Edw. Colley; and (iii) Thos. Colley of Babcary, yeoman
Mess. with curtilage and 2 closes on its S. side (5 ac.), 2 closes adjoining on S. (19 ac.), close on N. side (6 ac.), close in Wind hill (12 ac.), 3 rods in Furses, ½ ac. mdw. in Foddington Moore and 3 rods in Smeth Meade; in total 44 ac., all in parish and manor of Babcary; and cottage, etc. (2 ac.) in Babcary in possn. of Giles Hole.
