SUBJECT OF TRANSACTION: Recites will of Thomas Wyatt late of Nightingale Lane, Surrey Esq. and that testator died.
Recites that will was proved at Canterbury.
Recites that John Keal Biging one of the trustees-appointed by the will died 20 June 1841 and that 1. is desirous of appointing another (Ann Hale was the dau. of Thomas Wyatt and one of his legatees.
Recites that 2 intends to sell part of the annuities and bank stock mentioned in the schedule which formed part of the estate of Thomas Wyatt to cover the costs of the appointment, and to pay 2a. the sum of £71-7-6d. paid out by him for breaches of the testator's covenant to repair certain premises in Saffron Hill, Middx and for certain law cost in connection with such breach.
Now by virtue of a power given to her in the recited will, 1. appoints 4c. to be a new trustee of the will in the place of John Keal Biging In consideration of the premises and for the vesting of the freehold in 44. and in consideration of 50. paid to 2 by 3., 2. releases to 3. and his heirs :
Messuage with appurts in New Woodstock Freehold at Leafield which was devised to Thomas Wyatt by Elizabeth Cornish decd.
All property at Priors Hardwic k and Priors Marston, Warks, All other property of Thomas Wyatt in Oxon and Warks or elsewhere to hold to the use of 4. and their heirs for ever.
4. covenants to stand seised of: £10,000, 3% reduced bank and £2,000, 3% consolidated bank annuities, £1,000, 3% consolidated bank annuities, £200, 3% Hyde V/i/12 consolidated bank annuities, £2,250 capital stock of and in the undertaking of "The Gas Light and Coke Company" being 29 old and 16 new share, £950 capital stock in The Grand Junction Water Works being 19 shares, 12 shares in capital stock of the Globe Insurance Co., £200 capital stock in the East London Water Works being 2 shares.
(Part of the £200, 3% consolidated bank annuities is to be sold) and all other property of Thomas Wyatt so that they can perform the trusts declared in his will.
