Settlement before marriage of Thomas Eyton party and Elizabeth Campbell. Property settled after marriage to uses (a) that Thomas Eyton party should during the joint lives of his father and himself receive a yearly rent charge of £1,500 with power of distress (b) that Elizabeth in case she should survive him should receive for jointure £800 p.a. with power of distress etc (c) to use of Mackay and Larpent for term of 600 years in trust to secure the said £1,500 and £800 and for raising certain annual sums in an event (which has not and cannot now happen) (d) to use of Monckton and Majoribanks for term of 1000 years to raise £4,800 for younger children of the marriage (e) to use of Thomas Eyton the father for his life (f) remainder to use of Lord Bradford and Campbell during life of Thomas Eyton the father to preserve etc (g) remainder to use of Thomas Eyton party for life (h) remainder to Bradford and Campbell during his life to preserve etc (i) remainder to use of first and other sons in succession and heirs. The eldest or only son inheriting is within 6 months of his attaining the age of 21, make over to other children of the marriage who under the will and codicils of Elizabeth Campbell (mother of Elizabeth Campbell party) should become entitled to a portion or portions out of the trust money etc. bequeathed by that will all that share to which the eldest son should be entitled both absolutely and presumptively - if he should refuse or neglect to do this, the limitations under which he is entitled to the property shall become void but without prejudice to the uses limited prior to this limitation to the use of such eldest or only son and to other persons; the same condition to apply to the next person in remainder inheriting. If the eldest son should assign his share then it should be lawful for him to limit the said share in case such child or children should die before becoming entitled, to such person or persons as he should think proper. Thomas Eyton the father died many years ago. Thomas Campbell Eyton is the first son of Thomas Eyton party by Elizabeth his late wife formerly Elizabeth Campbell, and entitled as tenant in tail. He came of age 10 Sept. 1830 Thomas Campbell Eyton, Charles James Eyton, and William Archibald Eyton were the only children of the marriage. Recital of 2 December 1831.

2. Charles James Eyton and William Archibald Eyton T.C. Eyton assigned his share as directed in the settlement in sums of £7,188. 16. 8. 3% Consolidated Bank annuities £5,006. 10.9. 3½% red.d. Annuities, and £1,250 Bank Stock. A. proviso in the deed affects 1/3rd part in the event of C.J. Eyton and W.A. Eyton or either of them dying without having acquired a vested interest in the trust funds. Thomas Campbell Eyton desires to convey the remainder in fee simple in the hereditaments (part of those comprised in the recited settlement) to uses, and Thomas Eyton party as protector of the settlement has agreed. Consideration: performance of this desire and to defeat the estate tail of Thomas Campbell Eyton of the manors of Eyton or Eyton upon the Wealdmoors and Brotton als Bratton als Brocton, the capital messuage called Eyton Hall in Eyton with appurtenances (formerly Richard Bellis); messuage and land called the Shawbirch Farm (formerly Jane Beddow widow), messuage and farm house; 3 water corn mills (formerly Richard Cooper), messuage (formerly Martha Lane), messuage (formerly Mary Lane), messuage (formerly John Beard), messuage (formerly Sarah Steventon), messuage (formerly Margaret Twainley widow), messuage (formerly Jonathan Hainhold), messuage (formerly Richard Booley), messuage (Jane Arnson formerly), parcels land (formerly Andrew Adams), parcel land (formerly John Dabs), several parcels (formerly Thomas Webb) parcels land (formerly Margaret Ridgley widow), parcels land (formerly Ralph Griffiths), parcel land called Brade meadow (formerly Thomas Eyton esq deceased), messuage with garden (formerly Thomas Davies), messuage and garden and land (formerly Richard Steventon), messuage and garden (formerly John Steventon), messuage and garden (formerly John Roberts weaver), messuage with garden (formerly Robert Wellis), messuage and garden (formerly John Davies), all in Eyton: messuage and land in Bratton (formerly Thomas Eyton decd) messuage awland (formerly Austin) messuage and land (formerly Elizabeth Cooper widow), messuage and land (formerly Thomas Smith), messuage and land (formerly Ralph Griffiths), 2 pieces of land (formerly John Jones), 1 piece of land (formerly Catherine Griffiths), messuage and garden and piece of land (formerly Joseph Symonds), messuage and garden (formerly Richard Steventon), messuage and garden (formerly George Jones), messuage and garden (formerly Mary Gough), messuage and garden (formerly John Dabs) all in Bratton. Present tenants of properties in Eyton and Bratton- Thomas Eyton, Samuel Austin, John Cooke, Charles Townsend, Edward Sanstacy, John Griffiths, Samuel Bates, - West widow - Jenkins widow. Thomas West. - Southwick. William Reeves, George Clarke, Richard Vaughan, Richard Williams, George Snape, John Phillips, William Wood, Thomas Richards, John Johnson, John Thomas, John Wood. This list includes all the property of which T.C. Eyton is tenant in tail under the 1808 settlement, except messuages and land in Wellington (already sold - deleted), to be held subject to the estate for life of Thomas Eyton party but discharged from the estate tail of T.C. Eyton, to use of such persons and on such trusts as he shall declare, in default as to any part to which such direction shall not extend, to use of T.C. Eyton his heirs and assigns for ever.
