Description

Letter from J.P. to W.P.G. stating that the Receiver's accounts have been passed, with the consent of all parties. A certificate will be made to this effect and the Receiver's recognizances vacated. Messrs F.B. & C. have been notified and will forward the draft deeds, which are already prepared, to Mr Fitter. The Receiver's remuneration was fixed at 5/- commission on the gross returns. He has gone through the accounts and seen that all items in the nature of double entries have been omitted from the returns for the purposes of calculating the commission, which comes to about £1500 p.a. of which about £1500 is still due. It must be considered whether or not Mr Gelson's travelling expenses (about £250) should be deducted from his commissions. Ordinarily he would say yes, but on the other hand should he be allowed anything in respect of commission on the sale in which he was instrument. Mr Fitter agrees that it would be fair not to deduct the travelling expenses, but not to allow commission on the sale. The cash account for 2 June until the present will be ready well before completion so that the purchaser may pay the balance. The Executors accounts have also been passed. It only remains to take the Chief Clerk's general cerfiticate under the decree and get the cause heard on the further consideration which can be done upon consent minutes. The final distribution of the estate should be achieved before Easter. Including the 3/4din the £ already received, the creditors may expect a dividend of 12/6d in the £.
