Description

PARTIES:

William Brain the elder of Ensham, Oxford, tailor.

a. William Brain the younger and b. James Brain of the same place tailors (only children of 1.)

SUBJECT OF TRANSACTION:

Premises as cat. no. Blake. V/14.

B. Messuage or tenement with the yard garden barn and appurts. in Ensham heretofore occup. Thomas Webb and then of Jury Knoldin

C. 1 free messuage or tenement in Wootton and one free close to the same belonging with the appurts. held by yearly rent of 3d. Recites cat. no. Blake/V/14

Recites Deed of Appointment and Demise of 29 April 1833 in which premises B. were demised to 1. for term of 1,000 yrs. subject to redemption on payment by Jury Knoldin of £100 plus interest

Recites Surrender made at Court held on 9 July 1822 by John Buggins then of Wootton, carpenter of premises C. to the lord of the manor of Woodstock to the use of 1. and his heirs for ever subject to proviso for redemption on payment of £250 with interest

Recites Further Charge of 23 April 1823 in which premises C. were charged also with £60 lent by 1. to John Buggins

Recites Further Charge of 9 Feb. 1824 in which premises C. were charged with further sum of £100 and that the £100 was further secured by Bond

Recites that John Weller of Handborough, Oxford, farmer and James Mac Vitie the elder of the same place, farmer re jointly indebted to 1. in £100 secured by Bond of 15 Feb. 1820 in penal sum of £200

Recites that default was made by William Faichen on payment of the £500 and default was made by Jury Knoldin in payment of the £100 and some interest owing on both

Recites that the sums of £250, £60 and £100 (total of £410) advanced to John Buggins are owing together with an arrear of interest

Recites that the debt of £100 secured by the Bond of John Weller and James Mac Vitie is still owing together with an arrear of interest In consideration of the natural love and affection of 1. for 2. and of 10/- paid by 2. to 1. 1. transfers premises A. to 2. for the remainder of the term of 1,000 yrs.

For the same considerations 1. transfers premises B. to 2. for the remainder of the term of 1,000 yrs.

1. assigns to 2. the mortgage debts of £500 and £100 on the deeds of 6 May 1828 and 29 April 1833. and also the mortgage debt totalling £410 due from John Buggins and the bonds relating thereto and also the bond of John Weller and James Mac Vitie of 15 Feb. 1820 and the debt of £100 and interest - to hold to 2. and 1. appoints 2. his attornies to receive the sams of money, interest and premises.
