Copy Order by Master of the Rolls. Re Wakeman
Case re firstly a farm, houses and lands (119a 3r 15p) in or near the village of Priest Weston, in the parish of Chirbury (Richard Pryce); cottage and garden (1r 37p) in the said village (Thomas Richards); Farm, house and lands (122a 1r 26p) at Upper Hayton, Stanton Lacy (Wm Weaver) and lands in Upper Hayton; farm, houses and lands (121a Or 25p) at Rhiston in Churchstoke (Thomas James) and land (John Henry Meredith) devised by the will of Sir Offley Penbury Wakeman, deceased.
Secondly House called Rose Place and pieces of land (10a 2r 8p) in Claines, Worcs; Moat House Farm, Claines; Corn Meadow, Green Farm, Claines; strip in Checkett's Field, Claines; farm-house called Porter's Mill Farm, Claines; garden adjoining Bilford Lane, Claines; site of cottage and garden near Ladywood Farm House, Salwarpe, Worcs. - settled in pursuance of the will of Sir O.P. Wakeman. Petition of Sir Offley Wakeman & c on 3 May 1875 to the Master of the Rolls & c &c.
Opinion that it is proper under the will of Sir O.P. Wakeman that a sale whould be authorised of the messuages, farms and lands, reserving as to property at Upper Hayton all coalstones, ironstone, mines & c quarries under the same, and that the conditional agreement dated 5 April 1875 is a proper agreement of sale of part of the property. Order that the agreement be carried into effect and the property not in the agreement (except as to Upper Hayton property & minerals) be sold with the approbation of the judge. The money from the sale is to be paid into Court to credit of exparte Sir Offley Wakeman and others Shropshire uses.
