Description

The Rev. Humphrey Sandford and Mr. William Coupland (his trustee) to Thomas Tarleton esq. the Rev. Edward Bather (trustees of the Rev. W. Hopkins and Jemima his wife).

Indenture between Rev. Humphrey Sandford of Shrewsbury, and William Coupland gent. (trustee of the same Humphrey Sandford), 2. The Rev. William Hopkins the younger, late of Fitz, now of Shrewsbury, and Jemima his wife, nee Oliver, 3. Thomas Tarleton of Cloverley, esq., and Rev. Edward Bather of Meole Brace (trustees named and appointed by settlement previous to the marriage of William Hopkins and Jemima).

Whereas by indenture May 25, 1812 between Folliot Sandford of Bath, and Humphrey Sandford, 2. William Hopkins and Jemima, 3. Thomas Tarletor and Edward Bather, reciting that Humphrey Sandford had agreed with James Fleming Baxter of Ludlow for purchase of tithes, tenths and hereditaments for £4670, but contract had not been carried into complete execution. Folliot and Humphrey Sandford borrowed at interest £3000 from Thomas Tarleton and Edward Bather, with consent of William Hopkins and Jemima his wife, as part of trust monies in settlement previous to the marriage, upon joint bond or obligation of Folliot and Humphrey Sandford with manors, capital messuages, mentioned to be demised by Folliot and Humphrey, and tithes etc. by Humphrey as collateral security for repayment there of; Bond by Folliot and Humphrey Sandford for £6000 conditional for repayment to Thomas Tarleton and Edward Bather of the £3000

Witnessed that consideration of £3000 paid to Folliot and Humphrey Sandford by Thomas Tarleton and Edward Bather, by direction of William Hopkins and Jemima his wife, bargain and sale and demise to Thomas Tarleton and Edward Bather, of manors of Up Rossall and Edgton, with appurtenances, and messuages, farms, rents etc. in Up Rossall, Edgton, Brunslow, Horderley and Woolston, to hold by Thomas Tarleton and Edward Bather for 3000 years, proviso that void on repayment by Humphrey or Foliot Sandford of £3000 and interest at £5%.

Covenant between Humphrey Sandford and Thomas Tarleton and Edward Bather that within 2 months Humphrey Sandford would demise all tithes etc.

Within the parish of Edgton, to hold by Thomas Tarleton and Edward Bather for 3000yrs. subject to same proviso of redemption.

Whereas by indenture of lease and release, June 10 and 11, 1812, release between1.James Fleming Baxter 2. Humphrey Sandford, 3 William Coupland, consideration of £4,670 paid by Humphrey Sandford to James Fleming Baxter, bargain and sale by James Fleming Baxter to Humphrey Sandford and heirs, all that free chapel of Edgton with impropriations etc. and glebe lands, and patronage of chapel, then held by William Johnstone, to hold by Humphrey Sandford and heirs, to such uses as Humphrey Sandford shall direct. Remainder to the use of William Coupland, during life of Humphrey Sandford.

Present indenture, that in consideration of 10s. paid by Thomas Tarleton and Edward Bather to Humphrey Sandford and William Coupland, that William Coupland, by direction of Humphrey Sandford, William Hopkins and Jemima his wife bargained and sold to Thomas Tarleton and Edward Bather, all chapelry, tithes, glebelands, advowson, and other premises described by indenture of lease and release of June 10 and 11, 1812 as conveyed and assured. To hold by Thomas Tarleton and Edward Bather, heirs and executors for 3000 yrs from date of indenture of May 25, 1812, subject to proviso for redemption contained in previous indentures. Further; in default of any payment of £3000 by Humphrey Sandford or heirs, lawful for Thomas Tarleton and Edward Bather to enter into premises.

In Witnesses, parties to present agreement signed and set seals. Witnesses: Thos. Salt, Shrewsbury, Jno Crutchloe. Receipt by Wm Hopkins of £3000 from the Rev. them; Sandford on 23 Nov: 1821. witness: J:Bickerton Williams
