Indenture, assignment of mortgage.
(1) Thos. Webb of Sherborne Warks., gent., sole exor. of Wm. Ward of Woolston Warks., gent., who was surviving exor. of Rich Hinde of Lilburne Nhant, gent., during minority of Sam. Hinde of Lilburne, gent., grandson of above Rich. Hinde.
(2) Mary Ames late of Rugby Warks. and now of Lutterworth Leics., widow.
(3) Rich. Hinde of Oxford, mercer, grandson of Rich. Hinde above.
(4) Sam. Hinde of Lilburne Nhant, gent., grandson of Rich. Hinde.
Reciting demise dated 1 May 1714 between (1) Mary Ames as in (2) and son Thos. Ames, (2) James Davenport of Lutterworth Leics., barber, (3) Wm. Ward and John Farndon of Woolston Warks., gents., in which for £400. Mary Ames and Thos. Ames demised to Wm. Ward and John Farndon a messuage with appurts. in Ermitage alias Armitage Staff occ. by Wm. Bryan, also various closes & pieces of land --- Middle Leasow, Cockshutt Leasow, Alders, Thortley, Low Grounds, Headseas (in 4 parts), Little Pingle adjoining, Acre in Broad Meadow, Field Peeces, Little Cowleys, and Great Cowleys (formerly in 2 parts) and adjoining R. Trent --- all belonging to the messuage and in occ. of Wm. Bryan in Armitage and Handsacre (Hansacre. St.); also Willickes Closes in occ. of John Jackson; also several closes (7 a.) in West Field of Armitage purchased by late Thos. Ames, grandfather of above Thos. Ames, of John Cooke and others and in occ. of Benjamin Bolton; also moiety of Great Pingle (18 a.) in Armitage lying between Lee Lane and Back Lane leading to Brereton in occ. of Wm. Bryan; void on payment of £420. by Thos. Ames to Wm. Ward and John Farndon; further reciting that default made in payment of above £420., that Rich. Hinde appointed Wm. Ward and John Farndon exors. of his will until grandchild Sam. Hinde reach age of 21, he then to be sole exor., that Wm. Ward and John Farndon proved will in Prerogative Court of Canterbury, that sum of £400. above lent by Wm. Ward and John Farndon to Mary Ames and Thos. Ames were trust money raised out of estate of above Rich. Hinde, that Wm. Ward and John Farndon have since died, that Wm. Ward appointed Thos. Webb sole exor. of his will and Thos. Webb continued executorship of Rich. Hinde until Sam. Hinde reached age 21, that on coming of age Sam. Hinde proved will in Prerogative Court of Canterbury and assumed execution, that £400. principal sum owing, all interest having been paid by Mary Ames, that Thos. Ames lately dead and devised premises by his will to mother Mary Ames, that Rich. Hinde by his will gave surplus of his personal estate and his real estate to Sam. Hinde and Rich. Hinde equally, that it is agreed that Sam. Hinde have above £400. and that security be transferred to him for remainder of term, now for nominal sum (1) with consent of (2) & (3) to (4) premises as above. Specified covenants; void if £410. paid by (2) to (4) on 2 Nov. 1720.
