Declaration of Trust

2) Folliot Sandford Esq., of the Isle of Upper Rossall.

Recitation of part of the assignment of 10 parts of the same date (see 465/627)

Whereas by a bond of even date Folliot Sandford became bound to John Minor in £3,200 conditioned for the payment of the £1,600 with interest on 14 August next; & whereas £400 part of the £1,600, that part in the indre mentioned to be paid by John Minor to Mary Adney, was not the proper money of John Minor, but of Folliot Sandford and by him paid to Mary Adney, but it was agreed between F.S. & John Minor that the said several terms vested in Edward Harries, Edward Jeffreys, Mary Adney and Thomas Harries should be assigned to John Minor, Wm Minor, Walter Minor and John Kilvert as in the indre of Assignment is mentioned in the first place for effectually securing to John Minor £1,200 (which money was by him really advanced to Elizabeth Sandford, Barbara Sandford & Susanna Sandford) with interest to the same, so that the hereditaments might stand charged with the £400 (residue of the £1,600) for the benefit of Folliot..

Now John Minor declares that the £400 according to the assignment paid by him to Mary Adney was the proper money of Folliot Sandford by him paid to M.A., and it is agreed that John Minor and also William Minor, Walter Minor and John Kilvert shall stand possessed of the terms of years by the indre assigned to them after payment of £1,200 & interest to John Minor in trust for Folliot Sandford for securing to him the £400 so paid to Mary Adney with interest.
