Indenture of 3 parts between The Rev. Humphrey Sandford of Shrewsbury clerk and William Coupland gent. (trustee for Humphrey Sandford) 1st part, The Rev. William Hopkins late of Fitz but now of Shrewsbury clerk, and Jemima Hopkins his wife, before her marriage called Jemima Oliver, and Thomas Tarleton the younger of Cloverley esq. and the Rev. Edward Bather of Brace Meole clerk (the trustees named and appointed by the settlement made previous to the marriage of William Hopkins and Jemima now his wife.
Whereas by indenture of 25 May 1812 between Folliot Sandford of Bath esq. (Father of Humphrey) and Humphrey Sandford 1st part, and William Hopkins and Jemima his wife 2nd part, and Thomas Tarleton and Edward Bather 3rd part. After reciting that Humphrey Sandford had contracted with James Fleming Baxter of Ludlow Salop for the purchase of the tithes etc. mentioned and intended to be demised for £4670, and that the contract had not been carried into complete execution, and taking notice that Foliot and Humphrey Sandford having occasion to borrow £3000 Thomas Tarleton and Edward Bather had with the consent of William and Jemima Hopkins agreed to advance them £3000 part of the trust moneys mentioned in the settlement previous to the marriage upon the joint obligation of Foliot and Humphrey Sandford, and having the manors, lordships mentioned as intended to be conveyed and the tithes agreed to be granted by Humphrey Sandford as a further collateral security for the repayment with interest as mentioned, and that accordingly Thomas Tarleton and Edward Bather that day had advanced to Foliot and Humphrey Sandford £3000 part of the trust money. By a bond of the same date Foliot and Humphrey Sandford have become bound to Thomas Tarleton and Edward Bather for £6000. Conditioned for payment of £3000 and interest as mentioned.
Witnessed that in consideration of £3000 paid to Foliot and Humphrey Sandford by Thomas Tarleton and Edward Bather, by the directions of William and Jemima Hopkins, demise to Edward Bather and Thomas Tarleton of the manors of Edgton and Up Rossall with appurtenances, divers messuages, farms, Lands Events in Up Rossall and all farm lands etc. belonging and premises in Edgton, Brunslow, Horderley and Woolston; to hold by Thomas Tarleton and Edward Bather for 3000 yrs., subject to the several charges and incumbrances, and subject to the proviso for making void the term on the payment by Humphrey Sandford of £3000 by Nov. 25th next with interest at 5%. Agreement that Humphrey Sandford would within 2 months demise to Edward Bather and Thomas Tarleton all the impropriate and other tithes within the chapelry of Edgton, with rights and appurtenances. To hold by Edward Bather and Thomas Tarleton for 3000 yrs. to be computed from present, subject to right of redemption. Whereas by indentures of lease and release June 10th, 11th 1812, between James Fleming Baxter 1st part, Humphrey Sandford 2nd part, and William Coupland 3rd part; in consideration of £4670 paid by Humphrey Sandford to James Fleming Baxter, release by James Fleming Baxter of all that the free parochial chapel of Edgton with all tithes, oblations etc. and allglebe lands in the parish of Edgton, to hold by Humphrey Sandford for such trusts as are stated. To the use of Humphrey Sandford during his life time and the remainder to the use of William Coupland during the life of Humphrey Sandford, in trust for Humphrey Sandford.
Whereas the premises compromised in last recited indentures of lease and release are the premises agreed to be granted by Humphrey Sandford to Thomas Tarleton and Edward Bather. Whereas the sum of £3000 still remains due by virtue of the security to Edward Bather and Thomas Tarleton
Present witnesses that in consideration of 10s. paid by Thomas Tarleton and Edward Bather to Humphrey Sandford and William Coupland, William Coupland at the direction of William Hopkins and Jemima his wife, release to Thomas Tarleton and Edward Bather all the chapelry tithes, glebe advowson etc.; to hold by Thomas Tarleton and Edward Bather for 3000 yrs., subject to a proviso for redemption, that if Foliot and Humphrey Sandford shall pay Thomas Tarleton and Edward Bather £3000 and interest at 5% by the 25th May next, without any deduction for any taxes, charges etc. imposed on the chapelry, tithes, etc. term to clerk
Testimony by William Coupland that he has not caused the tithes etc. to be incumbered in any way to prevent the premises being so demised, and that Humphrey Sandford will pay to Thomas Tarleton and Edward Bather £3000 with interest at 5% by 25th May; that William Coupland and Humphrey Sandford have full power and authority to sell and demise the tithes and glebe lands etc.
Further that Thomas Tarleton and Edward Bather may if default is made in the payment of the £3000 and interest occupy and enjoy the profits of the tithes glebe land etc. freely and indemnified from all former grants, mortgages etc. committed by Humphrey Sandford. Further that Humphrey Sandford shall at the request of Edward Bather and Thomas Tarleton, but at his own expense make assurances for the better confirming the tithes, glebe etc. to Edward Bather and Thomas Tarleton for the residue of the term of 3000 yrs. Until default is made in the payment of the £3000 and interest Humphrey Sandford may enjoy the issues and profits of the tithes and glebe etc.
