Folios 320-341. Letter from James Saunders, Clerk to the East Dereham Local Board in the Mitford and Launditch Poor Law Union, to the Local Government Board. He writes to inform them that W H Nankivell [William Henry Nankivell], Surveyor, will be placing the following documents before them. A petition for a provisional order for the taking otherwise than by agreement of the land required by the Local Board for the purpose of the undertaking. A declaration by Nankivell showing that the requirements of Section 176 of the Public Health Act 1875, [38 & 39 Vic c55], has been complied with and exhibited viz. A B C. Copies of the Eastern Daily Press, the newspaper in which the necessary advertisement appeared on 3 consecutive weeks, 12, 19 and 26 November 1879.
D. A plan of the proposed undertaking with books of references and details in sheets annexed. E. Term of notice sent to owners, lessees and occupiers of lands proposed to be taken. F. The above petition and schedule of owners, lessees and schedule of owners showing the assents, dissents and neuter. The declaration of Nankivell as to service of notice on owners, lessees and occupiers with form of acknowledgement and exhibits marked A,B,C,D,E and F. The affidavit of Nankivell as to the deposit of plans and book of reference with the clerk of parliament and at the private bill office. He requests an acknowledgement that all these documents have in due time been received by the Board.
Petition of the Local Board for the District of East Dereham, Norfolk being the Urban Authority for that district shows that the petitioners are desirous of putting in force the powers of the Lands Clauses Consolidation Acts with respect to the purchases and taking of lands otherwise than by agreement. The lands being described in the attached schedule (F) as: Pasture land in the parish of East Dereham, Norfolk owned and occupied by Barry Girling.
Pasture Land in the parish of East Dereham, Norfolk owned by Francis Joseph Leigh and William Hartley, trustees under the deed of settlement made on the marriage of Elizabeth Tabitha Watts Daniel with Charles Duffield Faulkner and Ralph John Lyons and [William De Suettville], trustees under the deed of settlement of Harriet Jane Daniel with Francis Joseph Leigh and occupied by Jane King. Document is dated 16 January 1880 and signed by William Hyde a Justice of the Peace for the county of Norfolk.
Pasture land in the parish of Scarning, Norfolk owned and occupied by Barry Girling. Also states that the petitioners have complied with the provisions of Public Health Act 1875, 38 & 39 Vic c 55, with respect to advertisements and notices by publishing as described above. Signed by William D Bulwer, Chairman in the presence of Saunders, Clerk and dated 14 January 1880.
Declaration by William Henry Nankivell as surveyor to the East Dereham Urban Sanitary Authority is dated 26 November 1879 showing he complies with requirements of Section 176 of the Public Health Act 1875, [38 & 39 Vic c 55], as per the requires for placing the appropriate notice in a regional newspaper namely, The Eastern Daily Press.The declaration was also made in the presence of Hyde. Copies of the notice are present and marked B,A and C.

Annotated: [Mr Rawlinson] and The President. The East Dereham local Board apply for a provisional order to enable them to take lands compulsorily. 1. Write in usual terms saying that Inquiry will be held as soon as the other engagements of the Board's Inspectors will permit. As regards the works outside the district inquire whether notices under section 32 of the PH Act [Public Health Act] have been given and say that when time specified in the statute for the service of objections has expired the Board should be furnished with a statutory declaration showing that the requirement of this section have been complied with. Copies of the newspapers containing the advertisement and of the forms of notice served on the owners, lessees and occupiers and on the overseer and road authorities (if any) should be annexed to the declaration as exhibits. The Board should also be furnished with a copy of any notices of objection that may have been served on the Local Board under sec 33. If no such objection has been received this should be stated in the declaration not if any such objection has been made and not withdrawn the Local Board should pass a resolution asking the Board to appoint an Inspector to make the Inquiry and Report contemplated by section 34 and a copy of such resolution should be transmitted to the Board. 2. Prepare advertisement', 22 January 1880.
