[Recites: (A) Covenant to suffer a Common Recovery dated 1 Nov. 1689: (i) John, Lord Stawell, since decd.; (ii) Sir William Portman of Orchard Portman, bart., since decd., John Hunt of Compton Pauncefoot, esq., Henry Bull of Shapwick, esq., since decd., and John Sandford of Nynehead Florey, esq, and (iii) Sir Henry Goold, knt., a justice of Court of King's Bench (by the name of H. G. of the Middle Temple, esq.), and Nathaniel Ryder of Lyons Inn (co. Midx.), gent; for settling the manors, etc. described below. It was agreed that John Hunt and Henry Bull might demand against H. G. and N. R., who for that purpose were made tenants to the freehold by Bargain and Sale enrolled dated [blank] Oct. 1689, of:
The manors of Stony Stratton, Blackford, Woolston, Bishops Lydeard, Babcary, Prestleigh, Somerton, Aller and Oath; with all appurts;
and that H. G. and N. R. should vouch to warranty Lord Stawell, who should vouch the common vouchee; and that the assurances should be taken to enure to the use of Sir William Portman, John Hunt [etc.] for the term of 2000 years on the conditions and limitations set out in an Indenture of even date.
(B) Revocation of uses and-Declaration of uses dated 28 Mar. 1692: Lord Stawell to James Ward and Edward Herrys, declaring that J. W. and E. H. should stand seised of the sd. manors to their own use for 3000 years and then to use of sd. Lord Stawell for ever; to be made void by the payment of £5000 and interest by Lord Stawell to them at a date fixed: which sum was not paid.
(C) Assignment, dated 8 Mar. 1697/8: (i) Hon. Robert Cecil etc. [as in recital (B) in No. DD/BC/112], and sd. James Ward and Edward Herrys; (ii) Francis Bennet [as in No. DD/BC/112]; and (iii) Ralph Sherwood (appointee of (ii); reciting that (ii) agreed to purchase for £1834 16s. the fee simple of:
The manor and advowson of Babcary
To hold to (iii) for the remainder of the terms of 2000 and 3000 years in trust for (ii).
(D) Assignment, dated 26 Aug. 1700: (i) Frances Sherwood, execx. of Ralph S.; (ii) Edward Colley; and (iii) Thomas Colley:
Mess. and 44 ac.; and cott. etc. [as in No. DD/BC/117]
To hold to (iii) for remainder of the terms of 2000 years and 3000 years in trust for (ii)].
The said messuage, etc.
(To hold to Peter Davis for remainder of the terms of 2000 years and 3000 years in trust for Guydo Clinton).
