Lease and Release - conveyance on trusts (joined together)

Recital of lease and release of 17 & 18 Feb. 1829 (see above) and the common recovery in pursuance of the same.

T. Burd made the division of the property as directed.

The property in the schedule below formed Lot 1 and was drawn by Elizabeth Shuker and certain sums were directed to be paid to her and her husband for equality of partition, which have been paid. T. Burd has agreed to convey the premises to the Shukers. Now in consideration of 10s to Burd and the Shukers from Rd Duckett, Burd by direction of the Shukers, with the consent of the Evanses and Plimleys, conveys to Rd Duckett the messuages and pieces of land in the schedule below, in Maesbrook Ucha and Issa, Kinnerley (now or late David Humphreys and William Humphreys) shown on the plan on the last skin of these presents coloured pink, with all outhouses, buildings, barns, gardens, lands, timber and other trees etc. and all the estate and interest of Burd and the Shukers. To hold to Rd Duckett and his heirs to uses declared:- to the uses that Eliz. Shuker shall in their joint lives by deed appoint and in default to Wm Shuker abd Eliz. for their lives then of the survivor of them, then to such person as Eliz. by deed or will or codicil appoints, in default to Eliz. her heirs and assigns forever. Covenant to levy a fine to enure to the uses above.

Edward Edwards jnr. died on 31 December 1826

John Duckett made his will on 30 August 1800 appointing his son John and Edward Edwards snr., both decd., executors. John Duckett the son survivied Edward Edwards and died intestate and letters of administration of the goods and chattels of John Duckett the father limited so far as concerns the 2 terms of 600 years and 500 years in the premises in the indentures of 16 & 17 May 1780 and vested in John Duckett were granted by the P.C.C. to Wm Henry Rosser.

Edward Lloyd made his will appointing his widow and John Frank executors, who on 2 November 1797 proved the same in the Consistory Court of St. Asaph. John Frank survived his co-executor and died having made his will and appointed his wife, Margaret Frank, Thomas Lloyd, gent, and Edward Frank executors and the will was proved by Edward Frank alone at St. Asaph on 28 April last.

Letters of administration of the goods and chattels etc. of Sarah Edwards were on 6 Oct. last granted to Mary Plimley by the Consistory Court of St. Asaph.

The parties of the 4th part have been paid or allowed for in account the whole of the portion of the £500 and interest. It has been agreed that the residue of the terms of 600 years, 500 years and 500 years as far as resepcts the property before released to the trustees of the momination of Wm Shuker and Eliz. in trust as below.

Now in pursuance of the last agreement Rosser, by direction of the parties of the 4th part, and on the nomination and appointment of the Shukers, assigned, and the Shukers, Evanses and Plimleys quitclaim to Richard Griffiths, all and so many parts of the houses and lands in the settlement of 17 May 1780 as were limited to the use of John Duckett the father for 600 years and 500 years and all right of Rosser and the parties of the 4th part in the premises. To hold to Griffiths for the rest of the terms and during the interest of Rosser on trusts.

Now in further pursuance of the agreement Edward Frank assigns to John Williams all such part of the premises in the indentures of 16 & 17 May 1780 limited to the use of Edward Lloyd decd. for 500 years, to John Williams for the rest of that term on trusts as before.

It is declared that Richard Griffiths and John Williams shall stand possessed of the several terms of 600, 500 and 500 years in the premises in trust for William Shuker and Eliz. his wife to such uses as they direct and in the meantime to let the residue of the terms to be subservient to the uses declared before and to attend the freehold reversion.
