Description

He gives to William Henry Slaney of Hatton Hall esq, Robert Burton of Shelton and John Oliver Hopkins late of Fitz, now of Uffington, as trustees, all his collection of stuffed and preserved birds, insects, and other articles and speciments of zoology whatsoever, all his books, bookcases, cabinets, and cases in which these articles are contained or which are adapted to contain them, in trust to allow his wife Elizabeth Frances Eyton to have personal use and enjoyment thereof for her life, or during such shorter time as she may wish to retain them, and on trust to stand possessed of the collection etc for such one or more of the testator's children as at the death of the survivor of himself and his father Thomas Eyton esq shall be entitled to the freehold estates under a settlement made previous to his marriage dated 12 May 1835.

(6) William Henry Slaney and John Eyton in case such child shall declare a wish to possess the same; if within 12 months such child decline to express such a wish and to pursue the study of natural history, then the trustees shall sell the collection by public auction or private contract and invest the proceeds in their names in public funds or government securities or real security in England and Wales in trust as the remainder of Eyton's personal estate. He gives all household furniture, china, linen, plate, wines, and liquors which shall at his death be in the house then occupied by him, all horses, cattle, hay, carts, and other farming and other stock alive or dead to his wife absolutely. All his shares in any banking company, fire offices, canals, stock in public funds, monies and securities, and all the residue of his personal estate he gives to the trustees to convert into money and invest as before in trust to allow the testator's wife to receive interest for life for her own benefit, after her death to stand possessed of the same in trust for one or more of his younger children not entitled as tenant in possession to the freehold, if more than one as tenants in common, for his or their absolute benefit. If trustee die or disclaim or be unwilling or incompetent to act, his wife during her life and after her decease the competent trustees for the time being, or if none the executors or administrators of the last surviving trustees, may substitute another. Trustees may retain expenses etc.
