Description

Mrs. Harries and others to Mr. James Fleming Baxter.

Indenture of three parts; 1. Frances Harries of parish of St. Martins in the Fields, widow of John Harries of Lincoln's Fields, 2. Francis Chambre of Oswestry esq. 3. James Fleming Baxter of Ludlow gent. Whereas by indentures of lease and release Janury 20, 21 1775 made between John Harries (since deceased Francis Harries wife, one of daughters and devisees named in will of Edward Fleming, late of Sibdon Carewood, 2. John Cotes of Woodcotes, reciting that Francis Harries, before marriage was seised of in fee simple lands and hereditaments mentioned, from will of Edward Fleming, by death of brother Gilbert Fleming, entitled to 1/3 share of various lands. For consideration 10s. bargain and sale by John Harries and Frances to John Cotes of all premises. To hold by John Cotes to uses and on trusts declared and mentioned

Premises received by Frances from will of father to use of John Harries and heirs.

Covenant by John & Frances Harries to levy fine Sur Cognizance de droit, of all premises.

Whereas by indentures of lease and release Sept. 5 and 6 1776 between John Harries and Frances his wife and Hon George Duke and Earl of Manchester, Viscount Mondeville, and baron Montague, Sir Henry Oxenden of Broom, Kent, Baronet Henry Herbert of High Clare, of Southampton, hon and Rev. William Neville rector of Burghclere, Southampton, reciting that John Harries had applied to above persons for loan of £4000 on the security of above premises, release of to George Duke of Manchester etc. for sum of £4000.

Will of John Harries, May 20, 1724, Frances appointed as sole executrix. Whereas by indenture of lease and release September 27 and 28 1780 made between (Jonathan Barff of Oswestry, of second part, Frances Harries of first part) Frances Chambre of third part, bargain and sale by Frances Harries, and Jonathan Barff, premises mentioned to Francis Chambre and heirs, including mortgage to George Duke of Manchester etc. and subject to other incumbrances. Agreed between Frances Harries and Francis Chambre, that equity of redemption of remainder of premises to be conveyed to Francis Chambre.

Whereas James Fleming Baxter contracted with Frances Harries for complete purchase of the absolute fee simple and inheritance of messuages etc. 1st described granted and released by Frances Harries and Francis Chambre, free from all incumbrances, save for £4000 mortgage, at the price of £200. and Contract with Francis Chambre for complete purchase of premises 2ndly described for sum of £1,380.

Indenture witnesses that for consideration of £200 paid by James Fleming Baxter to Frances Harries, and 10s. to Francis Chambre, grant and release to James Fleming Baxter, all that messuage in Sibdon Carewood called the Hall of Sibdon Carwood, and one garden, Hembutts, and backside belonging. all lands, meadows pastures, leasows, feedings woods, underwoods, viz. the well yard, the pitt meadow leasow, the two pitt meadows, the guildy Bruch, the Great Hentley, the Great Furlong the New enclosure, the Gutter and Gutters meadow, the Low leasows, and Meadows, the Barley leasow, and Crooked lands, the Short Furlong and Guildy Meadow, the Great line acres, the Little line acres, and the Line acres meadow, the three great leasows, the line Crofts Meadow, the two great Meadows the Cold Hills and meadows, the Cow leasow, the Little Hall and the Bray meadow, all that messuage called William Greenwoods tenement, all those pieces of land, i.e.the backside, the 2 Garbuges, the 3 enclosures, in the field, the long acres, the stock in line croft meadow, the Dorling Silch, and the Mell, all of which premises are in Sibdon, formerly in the possession of John Tasker, all which premises were after in possession of Edward Fleming, James Lloyd, John Edwards homas Evans, Thomas Pugh, now or late in the holdings of Gilbert Fleming, ded., James Lloyd, John Edwards, John Oliver and Thomas Haycock, purchased by Edward Fleming and Ann Tasker, widow, and John her son; the free chapels of Sibdon and Edgton, with tithes, advowsons, glebe lands, etc., which premises were devised to Frances Harries by will of Edward Fleming, her father, in Sibdon, Stockesay, Hopesay and Edgton. To have and to hold by James Fleming Baxter and heirs, subject to the mortgage debt.

Further, in pursuance of an agreement of James Fleming Baxter and Francis Chambre, and in consideration of £1380 to Chambre, release to James Fleming Baxter of messuage, with barns, stables, orchards, etc., called Bruches in Sibdon Carwood of 2a 1r 11p ; several parcels of land, viz. a parcel called the Pikes 10a 36p, the Barn Field 6a 1r 15p, the barn leasow 9a 2r 33p, the Outlets 10a 9p, the Long Meadow 5a 2r 16p, Tiptons Gorsty Ground 6a 29p, the Bank field 3a 3r 5p, all of which belong to above messuage in Sibdon Carwood; 3 pieces of ground called the Stocken grounds 20a 2r 16p in Stokesay to the last messuage belonging, which messuage and lands were in the occupation formerly of Frances Tipton, late of John Edwards, now of Richard Bach; messuage in the holding of John Oliver, now in the tenure of William Tantrum 32p, a small parcel of land adjoining to the wood of the messuage 1r 5p, parcel of land called the Long Croft 1a 32p, all in Stokesay; 1/3 part of lands (to be divided into 3), of a piece called Carters Rool Eye 6a 1r 35p, pieces called Carters Weynols 9a 2r 8p, and the Stoney Meadow 7a 3r 32p piece on N. side of the Long Meadow 2r 22p, parcel to North of Tiptons Gorsty ground 1r 1p, which premises contain altogether 24a 3r 18p in Sibdon Carwood, in the tenure of Richard Bach, and all lands, etc. in the parishes of Sibdon, Hopesay and Stokesay, as conveyed by Frances Harries to Francis Chambre, granted and released to James Fleming Baxter and heirs.

Sealed and delivered by Frances Harries in the presence of John Ireland, and Hugh Smith, Lincoln's Inn, and by Francis Chambre in the presence of Robert Lawrence and Thomas Matthews.
