Purchase of tithes
1. The Rt Hon. Dame Hester Malpas, widow, only child and heiress of Sir Francis Edwards, decd.
2. John Bather of Shrewsbury, gent.
Recital of indenture of 20 December 1748 between Viscount Malpas and Hester (1) Thomas Kynaston of Exchequer Office, Lincolns Inn, gent (2)
Fine last Michaelmas to Thomas Kynaston of the tithes in Meole Brace and of 40 messuage, 20 cottages, 1000a land, 100a meadow, 400a pasture, 50a wood, 200a furze, 40s rent, common of pasture, and all tithes in the townships of Meole Brace, to the use of Viscount Malpas and Hester.
12 April 1749 mortgage between Viscount Malpas and Hester (1) Henry Jenks (2) to raise £2,500 to pay Viscount Malpas' debts, of the tithes to Henry Jenks to raise £2,500.
Lease and release of 3 & 4 November 1752 between Viscout Malpas and Hester (1) John Roberts, gent (2) The Rev. Thomas Gough, clerk (3) Henry Jenks and Francis Turner Blythe (4) John Oliver, gent and John Gardner, Esq (5) reciting mortgages by Viscount Malpas and Hester and Henry Jenks to F.T. Blythe of property in Shrewsbury and Meole for 500 years and 500 years to secure several sums; there is due to Blythe £3,050. John Oliver to purchase part of the premises in the terms of 500 and 400 years for £1,385 and that £550 to be paid to Blythe to reduce the debt to £2,500. So for £550 to Blythe and £835 to John Oliver, to barr entails conveyance to John Roberts of the tithes out of the parish of Meole, to suffer a recovery.
A recovery was suffered in Michaelmas 1752, for the Malpases for their lives.
The Malpases at Michaelmas 1753 levied to John Ashby a fine on the tithes.
John Bather has agreed with Dame Hester to purchase the tithes for £200.
So for £200 sale of the tithes from 6 pieces of land in Meole belonging to the Company of Drapers (19a 1r) (John Vaughan, gent, Thos Fowle, draper, Thos Gosnell, grocer, and John Scott, draper); 5 pieces in Meole (14a) belonging to the Governors and Trustees of the Orphan Hospital; a piece called Kingsland (24a) belonging to the Corporation of Shrewsbury; and out of a house or farm (24a) belonging to the Corporation of Shrewsbury (Governors of the Orphan Hospital, late in the holding of Isaac Pritchard, decd.); 8 pieces in Meole (32a) the estate of the Rev. Mr. Fowler of Atcham (now or late Edw. Tonge and Sam Heath, butcher); 3 pieces in Meole (10a) late of Elias Evans, gent, decd. (now General Severn); a croft in Meole (2a) of -- Waring, Esq (now or late Fowlks, gardener); a messuage and farm in Meole - Raddle Brook Farm (45a) the estate of William Berrington, Esq. (Rd Gittoes); 3 pieces (13a) the estate of Wm Berrington (- Ball); 3 crofts in Meole (9a) the estate of Wm Berrington (Walter Tench and Corbet Kynaston); a messuage or farm in Meole (35a) of - Kendrick, Esq, called Nobold Farm (Rd Plummer); 5 pieces (10a) of John Rocke, Esq. in lease to Thos Studleydecd (Corbet Kynaston, Rd Gittoes and John Jones); a parcel (5a) in Meole on the S.W. side of a piece of land called Muncorn Field, bang the estate of Wm Berrington (Mr Wm Franks); 2 crofts, gardens (Rowland Edwards, gent); 2 pieces in Meole called the Washford the estate of Wm Berrington (Rd Plummer), except the tithes out of Dayhouse Farm, Meole (Rd Juson); and a farm in Meole (Wm Franks); pieces of land (John Bowen, butcher); several pieces (Sarah Parrock, widow); being jointure lands of Dame Hester Edwards alias Wise, mother of Dame Hester, in Meole; the tithes of the jointure premises being excepted out of this grant and not intended to be sold to John Bather.
To hold to John Bather, forever.
