Draft Agreement

Recital of indenture of 28 April 1686 between Richard More then of Linley, Esq. since decd. (1) Thomas More then of Claines, Worcs, gent (2) Charles Cocks (3) reciting lease by Samuel More, Esq. and Richard More to Robert Rayworth, Esq. and to Robert Carr, Esq. of the capital messuage and lands below which had then expired, letting to Charles Cocks the capital messuage in Larden in which Jasper More, Esq. formerly lived (thentofore Frances Howells, gentlewoman) & c in Upper & Nether La den, Shipton, Morehouse and Bentleys (thentofore Thomas Withers or Thomas Howells, then or late Frances Howells). To Charles Cocks from the day before for 99 years or lives of Thomas More, Richard More and Susan More at a peppercorn rent, on trusts.

By assignment and mortgage of 23 January 1699/1700 between Thomas More (1) Charles Cocks (2) George Martin (3) reiting the lease to Cocks, Cocks at the request of Thomas More assigned to George Martin the said capital messuage and lands and all right of Thomas More and C. Cocks with the lease, from the day before for 99 years in the lease or the said lives subject to a condition of redemption in the assignment to be void on payment of several sums of money by Thomas More to George Martin.

By several mesne assignments the lease and assignment of the same became vested in Elizabeth Whitmore, spinster, afterwards wife of Edward Jellicoe of Stamkford, Brewood, Staffs, gent, since decd.

Notes to recite marriage settlement of April 1721 or 1722; judgement to Mrs Cotton for £700 defeazanced by indenture of 23 July 1722 for payment of £150 and interest and performing the marriage agreement of Mr More and his wife, and that Mrs Cotton lent a further sum.

Deed of March 1722 from Mr More to Mr Baldwyn for raising £60 a year for payment of the debts in the same.

Assignment from Jelicoe to Kidson and Wharton of 25 Dec. 1722 to secure a sum.

Deeds and assignment to Mr Thomas Cotton entitled to the debt due from Mr More to Mrs Elizabeth Cotton; what is due to him; what is due to Mr Baldwyn. To pay it Mr Baldwyn has filed his bill in equity against T.C. & J.M. (Jane More).

It is agreed as follows:-

Whereas Thomas Baldwyn did not receive from Thomas More in his life or from anyone after his death, any part of £60 a year towards payment of £100 and interest due to Martha Baldwyn and the £70 and interest to Anne Minshall on which Thomas Baldwyn filed his Bill in Chancery for recovery of the same and several other debts, i.e. to Thomas Baldwyn £200 due by bond of 31 Jan. 1709/10, £50 due to Thomas Baldwyn by his note of 11 June 1709. The rents and profits of the estate since the death of Thomas More have been received partly by William Wharton and William Kidson towards payment of their debts and applied in repairs and other outgoings, and the residue, except what is in the tenants' hands, has been received by Jane More; for preventing further expenses and suits re the premises it is agreed between the parties that Jane More shall pay to Thomas Baldwyn out of what she has from the annual rent of £60 towards discharge of the debts in the lease of March 172- by Thomas More to Thomas Baldwyn £105 the receipt of which Baldwyn acknowledges and he will receive and take out of the yearly rent of £60 £30 to be paid him by the tenant of the premises who agrees to pay it on 29 Sept., and £30, the other part of £60 to Thomas Cotton in discharge of his debt and after these debts have been paid the £60 is to be applied to paying the other debts of Thomas More.
