Description

1. Anne Dobson Smith of Bootham, City of York, [co. York]. spinster.

2. John Anwick Smith of Langley Grove, co. Durham, gentleman.

3. John Smith of Langley Grove, esquire.

4. Joseph Gibson of Whelprigg, Kirkby Lonsdale, esquire.

Recitals:- will of Thomas Garnett of Bank House near Barbon, Kirkby Lonsdale, clerk made 24 September 1859 bequeathing premises [as below] to mother Mary Fleming Garnett (his executrix) for life, then to sister Georgiana Kendal Smith of Langley Grove, co. Durham on condition that £2,000 be paid to (1) within 12 months of mother's death; otherwise the estate to go to (1);

- Death of Thomas Garnett on 11 August 1859, a bachelor;

- Will proved District Registry Carlisle on 10 November 1859;

- Thomas Garnett and Georgiana Kendal Smith the only children of late Robert Skyring Garnett;

- Georgiana Kendal Garnett married (3) on 29 July 1841;

- Georgiana Kendal Smith died on 13 June 1860, leaving (2) her eldest son and heir-at-law;

- Death of Mary Fleming Garnett on 2 October 1862 and burial at Barbon Chapel;

- (2) 21 on 24 April 1864.

Premises: all that and those the freehold messuages or tenements and farm with the yards, barns, stables, curtilages, offices, outbuildings, orchards, gardens and appurts. belonging and the several closes, inclosures, pieces or parcels of land or ground mentioned in schedule, in Barbon, Kirkby Lonsdale called Bank House or High Bank House, in occupation of Mr James Read as tenant and containing 45 acres and 23 perches, [see plan and schedule].

Covenants include:- no wife of (4) to claim dower.

Consideration: £2,000 from (4) to (1), as legacy, at request of (2) and £2,000 from (4) to (2).

Witnesses: J S Cranwell, Recorder of Durham, Jane Smith, York, Gradwell Pearson, Solr., Kirkby Lonsdale.
