Indenture made between Frances Harries, widow of parish of St. James Westminster, Middlesex, devisee named in the will of John Harries, late of the Middle Temple, one of the daughters of Edward Fleming deed, of Sibdon Password of one part and sister & co heirs of Gilbert Fleming deed, 2. Sir John Swinnerton Dyer of St. James Westminster, baronet, Joseph Bullock of Cavensfield, Bucks, and George Richards of New Inn, Middlesex, gent.
Whereas by indenture of mortgage April 19 1776 between the Rev. Edward Harries clerk, 2. John Baxter esq. Richard James surgeon, and Ann hiswife, John Harries and Francis his wife, 3. Griffin Ransom esq. I n consideration of £8000 to be paid by Griffin Ransom to John Baxter, Richard James, and Ann his wife, and John Harries and Francis his wife, in proportions therein mentioned, and for other considerations, he Edward Harries, at the request of John Baxter, Richard James, Ann his wife and John Harries and Francis his wife, assigned, transferred to Griffin Ransom the lordship of Westhope in the parish of Diddlebury, the chapel of Westhope, and several messuages, farms, lands, etc. in the lordship of Westhope, the capital and other messuages in Shadwell in the parishes of Clun and in Reilth in parish of Mainstone, herein after released and conveyed, by indenture of release, March 26 1740 therein recited, limited to the use of Thomas Cromp and Robert Phillips for term of five hundred years, upon trusts mentioned and declared.
To hold by Griffin Ransom and his heirs for the remainder of 500 years., created by indenture 26 March 1740 subject to proviso, that if John Baxter, James Fleming Baxter, Richard James, and Ann his wife, and John Harries and Francis his wife, should pay to Griffin Ransom £8400, in shares and proportions, mentioned reoccupation of premises by above.
By indentures of lease and release, September 5 and 6, 1776, between John Harries, Frances his wife 2 most noble George Duke and Earl of Manchester Sir Henry Oxenden Baronet, Henry Herbert esq., (Now Lord Porchester) and the Hon. and Rev. William Neville, for consideration of £4000 to be paid to John Harries and Francis his wife, they John and Francis, in pursuance of power in, and by indenture of release January 21 1775, did direct that all that the messuages, land etc. mentioned should be to the use of George Duke of Manchester etc. and heirs, proviso as expressed before, and released to George Duke of Manchester etc. that messuage called Sibdon Hall, and two messuages called Greenwood tenements, and the Brushes, and several lands in Sibdon Carwood and Rowton in parish of Stoke and chapel of Edgton with glebe and advowson. To hold by George Duke of Manchester, proviso that if repayment of £4000 and interest of 5% made on March 6 1777, premises recovered to the use of John and Francis Harries.
Whereas, Last will of John Harries devised all estates real and personal to wife Francis, appointed executrix of will, proved same in the prerogative court of Canterbury.
Whereas, Principal sum of £8000, secured by indenture, April 19 1776, due and owing to Griffin Ransom, and interest. from 19 October last
Whereas principal sum £4000 secured by lease and release September 5 th 6 1776, owing to Duke of Manchester. Whereas Francis Harries by bond, February 1 became bond to Charles Herbert of Brook Street parish of St. George Hanover Square, for £720 with condition that to be void on payment to Charles Herbert the sum of £360 with interest. Whereas Francis Harries is seised of a 1/3 part in the manor of Westhope, and other messuages comprized in the indenture of assignment recited 19 April 1776. Released and conveyed in fee simple and inheritance, subject to the payment of £2666 13s 4d being 1/3 of £8000 secured to Griffin Ransom. Seized of messuages, lands and tenements as recited in the indentures of lease and release of 5 and 6 September 1776; of 1/3 share in the lordship of Sibdon Carwood and the Hall at Sibdon. Francis Harries is desirious of selling her share in the manor of Westhope, etc. so agreement to convey all premises to Sir John Swinnerton Dyer, Joseph Bullock and George Richards.
This indenture witnesses bargain and sale by Francis Harries in consideration of 10s from Sir John Swinnerton Dyer, Joseph Bullock and George Richards, of one undivided 1/3 part of the manor of Westhope in the parish of Diddlebury, the chapel of Westhope, and several messuages in the manor of Westhope, i.e. the messuage called the Farm and lands formerly in theoccupation of William Higgins, now of Henry Haynes, messuage called the Lower House, formerly in the occupation of Henry Haynes, now of Richard Gough, messuage called Moore Wood and lands in the possession of Thomas Greenhalgh, now of Richard Gough, messuage called Moores Wood, in the occupation of John Hill, with enclosed lands in possession of Richard Fleming, snr, now or late of Richard Gough, messuage called Hill End, late in the possession of Edward Amis, now of Thomas Reynolds, messuage of Griffith Davies, now of Amis, messuage of Widow Hotchkiss, late of Widow Batley, now or late of Richard Batley, messuage late of John Pritchard, now of Richard Batley, messuage formerly in the occupation of Edward Harper, then of Widow Harper, now of John Griffiths, messuage of Richard Matthews, messuage of John Griffiths, messuage of Trustram and widow Bright, now of John Griffiths, messuage of Edward Hartley, cottage, garden and close of Robert Rowlands, parcels of land of Thomas Smith, parcel of meadow called Corfield meadow, late of Thomas Rowlands, now or late of Richard Gough, all coppices and woodlands in Westhope called Long Copps, Moores Wood, Burwood, estimation 120 acres; 1/3 part of all that capital messuage called the Farm of Shadwell in the parish of Clun, other messuage, once used as part of Shadwell farm then divided from it, called the New House, with woods and coppice belonging, formerly of Richard Parry, then John Parry, now of John Lewis, messuage called the Three gates, formerly of John Cleeton, now of John Lewis, messuage called the Broneth, of Samuel Oliver, now or late of Jeremiah Lewis, barn and close in Clun of Thomas Matthews, now or late of Jeremiah Lewis, burgage and garden of Hawkins, glazier, now or late of Ann Richards, burgage, garden and close in Clun, formerly of Beaven, messuage called the Reilth in the parish of Mainstone, of John Price, then William Leak, late of Hugh Pugh and Thomas Bird, undertenants of Edward Fleming, now or late of John Lewis, cottage, garden and close late of Edward Fleming, now of William Griffiths, messuage called The Ashes in the parish of Mainstone, of Matthew James, after of Samuel Bird or other undertenants of Joseph Corbyn, gent., and all other manors, lands and premises assigned by indenture of 19 April 1776 to Griffin Ransom.
And that messuage in Sibdon Carwood called the Hall of Sibdon Carwood, and garden, hempbutts and backsides belonging and woods, lands, leasows and pastures, the Well Yard, the Pitt Meadow Leasow, the two Pitts Meadows, the Guildy Brush, the Great Hentley, the Great Furlong, the New Inclosure, the Gutter and Gutters Meadow, the Low Leasow and Meadow, the Barley Leasow and Crooked Lands, the Short Furlong and Guildy Meadow, the Great Line acres, the Little Line acres, and the Line acres Meadow, the three great Leasows, the line crofts meadow, the two great meadows, the cold hills and meadows, the cow leasow, the little Hall and the Bray meadow, messuage called William Greenwood's tenement, several pieces of land:- the backside, the two carbuges, the 3 inclosures, in the field, the long acres, the stock in the line croft meadow, the Dorling Silch, and the Mell, all which premises are in Sibdon Carwood, formerly in possession of John Tasker, the messuage called the Bruches, 4 parcels of land called the Pikes, 5 parcels called the Bruches, the long Meadow in Sibdon. 1 piece of ground called the Slang, 3 pieces called the Stockins land in the township of Broome in Sibdon and Rowton, in the parish Stoke, formerly in possession of Francis Tipton, after in the holdings of Edward Fleming, James Lloyd, John Edwards, Thomas Evans and Thomas Pugh, now or late of Gilbert Fleming, decd., James Lloyd, John Edwards, John Oliver and Thomas Haycock, purchased by Edward Fleming from Ann Tasker, widow of John Tasker, and John their son and heir; chapel of Edgton, impropriation, tithes and globe lands with appurtenances and advowson, etc. by indentures of lease and release of 5 and 6 September 1776 conveyed to the Dukes of Manchester, Sir Henry Oxenden, Lord Porchester and William Neville.
Chapel of Sibdon, impropriation and tithes and advowson, and 1/3 part of the lordship of Sibdon, with capital messuage called the Hall formerly of Richard Bird, then of Richard Fleming, father of Edward, decd., then of Edward Fleming, now or late of Gilbert Fleming; 3 several messuages in Sibdon Carwood in the occupations of Widow Russell, Francis Williams, William Matthews, then of John Thomas, James Watkins, John Moyle, messuage of Thomas Bird, messuage in the occupation of John Carter, then of Elizabeth Carter, with several parcels of arable and pasture land; 3 parcels of arable c. 3 acres, adjoining together, near the messuage, 3 other parcels of arable and pasture and meadow land - 1 called the Rowley Leasow, 1 the Rowley Meadow, the third the Sty Napp, 8 acres in all, 3 other parcels, 2 called Waynalls Leasow, 7 acres, the third called Waynalls Meadow, c. 1 acre, 1 other parcel in Sibdon field, 4 acres, now enclosed, one other parcel in a common called the Lower Common, 4 acres, also enclosed, 1 parcel on upper side of the common 12 acres, called the Cowters, 2 acres in the possession of John Davies, of John Carter, adjoining to the Lower Common, messuage in Sibdon in the tenure of Samuel Nethway, then of Thomas Bird and Richard Fleming, in Sibdon, once in the tenure of Mary Owen, widow, and Thomas Haycock, then of Thomas Hughes, messuage in Hopesay called Oldfield, in the tenure of Jeremiah Nethway and Thomas Hughes, after of Richard Fleming and Thomas Hughes, 2 cottages erected upon part of the tenement, one in the occupation of John Robinson, the other of Nicholas Jarratt, after of William Nethway and Higgins; that cottage, garden and close of Edward Fleming, and two pieces of land called Dolvoroy in the parish of Mainstone, that messuage with lands in waste place called the Forest of Clun, called Comb Moch with the sheep walk on the Ridings, first of Edward Brown, then John Walcott now of Richard Fleming, and all other manors etc. as mentioned, devised to Frances Harries by the will of Edward Fleming, late father. To have have to hold above premises by Sir John Swinnerton Dyer, Joseph Bullock and George Richards, upon trust that they and their survivors shall be able to sell premises for best price obtainable.
The Trustees of heirs of survivor shall pay out of the sale of 1/3 manne& lands proceeds £2666-13s4d, (according to the indenture of April 19, 1776) 1/3 part of £8000 owing to Griffin Ransom, a interest.
From residue of money received fromthe sale of premises in indnes of 5& 6 Sept 1776 to pay £4000 to Duke of Manchester Sir Henry Oxenden, Lord Porchester and William Neville by terms of indenture Sept. 5 and 6 1776. To Charles Herbert £360 due and owing virtue of bond and interest. After payment of the aid principle sums and interest, residue to Frances Harries and heirs.
Further trust that John Swinnerton Dyer, Joseph Bullock and George Richards and survivors shall apply issues and profits of premises viz.
Profits of 1/3 of manor of Westhope etc. to Griffin Ransom, as interest on £2666-13-4d.
Profits of 1/3 manor of Sibdon and premises there to Duke of Manchester etc. as interest on £4000. Also to pay interest to Chas. Herbert on the £360.
Residue of rents and profits to Francis Harries and executors, for use of. her & them.
Provided that trustees, John Swinnerton Dyer etc. shall deduct charges and expenses to themselves out of profits.
