Description

1. Elizabeth Francis Slaney of Walford Manor spinster.

2. Thomas Campbell Eyton of Eyton esq.

3. Francis Muckleston of Walford House widow.

4. Robert Aglionby Slaney of Walford Manor esq and Elizabeth his wife, father and mother of E.F. Slaney.

5. John Oliver Hopkins of Fits clerk and Robert Burton the younger of Shelton esq.

6. William Henry Slaney of Grays Inn esq and John Eyton of Sidmouth Street, Regent Square, St. Pancras esq.

7. Thomas Bulkeley Owen and Francis Nevitt Leighton struck out). Recital of will of Joseph Muckleston (see 665/480) and of deed of 11 May 1835 (665/480. Consideration: this agreement and the power given to E.F. Slaney by this deed of 11 May. Draft appointment of the property to uses as now expressed. Release of the property to Hopkins and Burton as in 1st schedule and 2nd schedule, subject to the estates for life of R.A. Slaney and his wife and estates limited to their sons, to use of E.F. Slaney and her heirs until the marriage, then to use of W.H. Slaney and J. Eyton for term of 100 years on trust as soon as E.F. Slaney is intitled in possession to pay out of the profits or raise by mortgage sale or demise £200 p.a. by 4 quarterly payments clear of taxes for her use and not subject to the control of her husband, after payment to allow the person for the time being entitled to the reversion immediately expectant on the determination of the term of 100 years, to receive the rest of the profits. After the decease of either T.C. Eyton or his wife and after payment of all arrears of the £200, the term of 100 years shall become void. After the determination of this term and in the meantime subject to it the trustees are to hold to use of T.C. Eyton for the joint lives of himself and E.F. Slaney, and to support etc, after if E.F. Slaney survive to use of her and her assigns for her life, trustees to preserve etc, if T.C. Eyton survive her and there are children living, then to use of T.C. Eyton for joint lives of himself and such issue, after determination of that estate during their joint lives, to use of trustees to support etc. (A clause establishing a term of 500 years deleted), after to use of sons in succession and heirs of the body or daughters in succession and heirs of the body (a clause including Mary Slaney next, daughter of R.A. Slaney and Elizabeth his wife, and her heirs deleted) in default to use of Frances Catherine Slaney another daughter of R.A. Slaney and Elizabeth Slaney in defaults to use of all daughters of Elizabeth Slaney as tenants in common and the heirs of their bodies, in default as to property in the 1st schedule to use of Plowden Presland of Harnage esq his heirs and assigns for ever; as to the property in the 2nd schedule to the use of the Rev. John Fletcher Muckleston of Lichfield clerk and his assigns for his life, after to use of Hopkins and Burton during his life to support etc, after his death to use of his 1st and other sons in succession and heirs male of their bodies, in default to use of the heir or heirs at law of Joseph Muckleston A clause relating to the term of 500 years deleted. Marginal note by T. Eyton "This charge I think ought to remain, otherwise by keeping the estate unincumbered you are holding too great a temptation to your daughter to marry again whatever number of children she may have by her first marriage T.E.". Proviso that if T.C. Eyton die before his wife, she may after a second marriage appoint to the use of such husband an annual sum not exceeding £400 free from taxes. (Marginal note by Eyton "This unconditional Power is, I think, highly objectionable it is offering a premium to any adventurer to marry my son's widow whatever number of children she may have by him. At all events Mr. Slaney agreed that the power should be restricted to a rent charge to commence after her decease and only in case she should by her second husband have issue that would succeed under the above limitations of the Walford and Merrington estates and the duration of it to be confined, as in the case of my son, to the joint lives of such issue and her future husband T.E." "This to be altered as stated by Mr. Eyton, R.A.S." Power for E.F. Slaney to raise up to £5000 for children of a second marriage T.C. Eyton during the joint lives of himself and E.F. Slaney or E.F. Slaney if she survive him, for life, or T.C. Eyton in case he survive during the joint lives of himself and issue living to make demises up to 21 years. Provision for sale etc of parts of the estate by the trustees and for reinvestment to same trusts; provision for new trustees be nominated.

Egerton Jeffreys jun. perpetual commissioners for taking the acknowledgements of married women, 16 May 1835. On back sheet, note of signatures to deed Witnesses: William Witton butler to Robert A. Slaney, Francis Plimley, footman to Thomas Eyton, David Hughes, footman to Robert A. Slaney, Samuel Watson 13 Grays Inn Square, London.
