Description

Report of John Silvester, Recorder of London, on 1 collective petition (4 people, comprising the prisoner, the prosecutor, the victim and John Parker) on behalf of Thomas Humpage, packer, indicted at the Old Bailey in January 1809, for the assault on Margaret Howell and the theft from her of £8 in bank notes (stated in the petition to be the property of Henry Moggridge). He was convicted of stealing the note but not of robbery. Evidences supplied by Margaret Howell, spinster; John Wain, merchant; John Ashton, merchant and Henry Moggridge, boot and shoemaker, and brother of Howell. There are letters from H Thornton MP and the prisoner to Mr Night. Grounds for clemency: previous good character, prisoner was contrite, has a young family and aged mother to support who are totally dependent on him, his wife has died, he states that part of his wages will go to his children's support, he fears being sent to the hulks, he acted on a sudden impulse of temptation and he wishes to enlist in HM Navy (which other prisoners are being allowed to do). Initial sentence: 7 years transportation. Recommendation: no mercy. Folios 54-62.
