Smyth states that Barton was indebted to the petitioner and died, and Crewker, his successor as master of the hospital of St Bartholomew in West Smithfield promised to pay Smyth the debt and other duties that were between Crewker and him. Smyth sued to Crewker for payment, but he would not pay him against all good disposition of priesthood, and laboured by all means to destroy the petitioner, and had him impeached of treason. That failing, Crewker brought an action of trespass in London against him, but was non-suited. Smyth then obtained an action of debt against Crewker in the city of London and it was pleaded to issue, and when 12 of the neighbours of Crewker came to determine the judgment for the debt, Crewker by his craftyness and subtlety purchased a habeus corpus from the common pleas to remove the action of London before the justices of the common pleas. The justices seeing the subtlety returned it to London. Crewker then had the petitioner arrested by a writ of the statute of labourers, and Smyth was imprisoned for 6 days, but Crewker was utterly forsworn. Crruker then laboured to the mayor of London to have the matter examined before him, but again the subtlety was seen, and the action returned. And when the matter should have been determined by the course of the common law, Crewker had Smyth arrested by the warden of the Fleet prison, and he was imprisoned and was forced to find surety to appear from term to term to answer to Crewker though he knew of no cause. And seeing that all of this had failed, Crewker purchased a writ of privilege supposing him to be your household servant, which is known to be untrue, so may it please the bishop, considering the premises and the untruths, that the bishop not take him as his servant to defraud the petitioner from his duty which will be to Smyth's utter undoing, and without the bishop's lordship, Crewker will be more merciful in this behalf.
