Description
Petitioners
Thomas Tremayn of Devon.
Name(s)
Tremayn, Thomas
Addressees
King and the full discrete lords assembled in the present parliament.
Nature of request
Tremayn complains that his father held the manor of Rake in his demesne as of fee, and after his death, the petitioner entered the same as heir and held it until ousted by the earl of Devon. He has requested to the earl and his council that the matter of the petitioner's possession, title and right be enquired into, and it was examined and found for the petitioner, but the earl continued in possession and in taking the profits and the manor is destroyed and ruined to the petitioner's utter impoverishment. Because of the great might and birth of the earl, and because most of the gentry of the county are of his homage or his tenants, the petitioner cannot sue an assize. He requests that the earl who is at the present parliament be commanded to appear before the council daily, and there to answer the premises and be examined so that right can be done to the petitioner, and that it might be commanded to the earl upon his allegiance or on a notable pain that he not depart the parliament until he has been examined.
Nature of endorsement
[None].
Places mentioned
Rake, Devon.
People mentioned
Nicholas Tremayn, father of the petitioner
Thomas [Courtenay], earl of Devon.
Note
The petition is dated to? 1442 because the petition refers to events on 3 November in the 18th year of the reign which must be of Henry VI by the hand, thus making 1439, and the petition itself is clearly a petition presented to parliament by its address and request clauses, so seems likely to be presented to the first parliament after this date, namely that held at Westminster in January 1442.
