Aysshe and the other petitioners state that they are owners and possessors of a tinwork or mine called Gryball Parke, otherwise called Holeclyff within the jurisdiction of the prince's tin court of Ashburton, and that they were peaceably seised of the same without any claim until Revell and Edward claimed the tinwork in the court against the custom of the court and demanded the profit from the same. The petitioners came to the stannary court and said that they should not answer because one John Ganerok 'pight and boundid' the tinwork out of the Revell and Edward's possession and was possessed of the tinwork for six years without challenge of anyone, and after he had abandoned it the petitioners 'pight and bounded' it as their own freehold according to the custom of the stannary, and demanded judgment against Revell and Edward. Revell and Edward replied that the petitioners had 'pight and boundid' it out of their possession and the matter went to issue, and the plea was entered in the steward's book. Revell and Edward sued out a venire facias directed to the bailiff of the tincourt returnable in the next tincourt before Christmas, at which the bailiff laid in his warrant and the panel of 24 tinners to determine the issue, the which warrant is yet to be showed of the steward's own handwriting, and notwithstanding Thomas Fulford there and then admitted them to prove the said tinwork, the issue not having been determined, nor tried contrary to the custom and all good conscience. They request that the matter be considered, and that by the discretion of the council a reformation may be had on this, remembering how the petitioners and tenants have been ruled and entreated and that it has been an old custom in the stannary that no man shall be received to prove any tinwork upon the second 'picher and bounder', but only on the first, and if it now be otherwise it will be to the destruction of the tincourt, and will also cause so great trouble and error to many of your tenants that it will be hard to redress.
