Description
Petitioners
Walter de ....
Name(s)
Walter
Addressees
King.
Nature of request
The petitioner requests that he can have a writ to the justices in Ireland for another inquisition to be taken, because he is ousted from his land to his great damage by Exeter's espousal of the daughter of Devorgil Prendelgast who brought the suit against him. He was impleaded by writ of entry by Prendelgast before Exeter at Cork for 80 acres of land with appurtenances in Kilclonagh, and when he came to answer, he requested to see the writ, but could not do so because it could not be found. The petitioner then said that he was not bound to answer to Prendelgast without the writ, but Exeter, who had married Prendelgast's daughter, said that he should answer without the writ by enrolment and put it to the country, and Exeter took the country and examined the inquisition at his will, and Prendelgast recovered the land because the jury did not dare say anything but at the will of Exeter who maintained the plea of Prendelgast, his mother-in-law.

Note
The petition is dated to c. 1285-c. 1310 as the petition refers to Richard de Exeter as justice in eyre in Ireland, and unfortunately a father and son sharing the same name held the office and would have served on eyres in this period, so that dating at this time cannot be narrowed (Hand, G. J., English Law in Ireland, 1290-1324, pp.41-2, 248).
