SC 8/341/16080
Date
[? 1427]
Description
Petitioners
Nicholas Stanshawe; Margery Stanshawe.
Name(s)
Stanshawe; Stanshawe, Nicholas; Margery
Addressees
Duke of Gloucester, Guardian of England, and lords of parliament.
Nature of request
[This petition is badly faded] Nicholas Stanshawe and Margery [Stanshawe] his wife state that they have long been seised, of Margery's inheritance, of the manors of Hempton and Sturdon in Gloucestershire, and that they were put to answer before the council concerning these manors by writs of scire facias, arising from a bill of William Wydecombe, presented to the council and endorsed by authority of parliament, although William could have had a remedy for his complaint at common law by writ of entry upon disseisin. These writs of scire facias were pending before the council at Michaelmas in the king's second year, and still are, and they appeared and have been adjourned from term to term, contrary to the Great Charter and other statutes and ordinances, and to their great harm, annoyance and expense, and to their final destruction, if they do not have a remedy. They ask that the Duke and lords might ordain, by authority of the present parliament, that they might be discharged from their continual response to this bill, and that anyone who has a grievance against them might sue at common law.
Nature of endorsement
[On face] . . . by the Keeper . . . 10 December.[None on dorse]
Places mentioned
Henton (Hempton), Gloucestershire
Storden (Sturdon), Gloucestershire.
People mentioned
[Humphrey of Lancaster], Duke of Gloucester, Guardian of England
William Wydecombe (Widdecombe).
Note
The mention of 10 December in what can still be read of the note on the face, the address to the Duke of Gloucester, Guardian of England and the lords of parliament, and the mention of the king's second year as some time ago, might suggest the parliament of December 1420, but as an award was made regarding this property on 15 February 1428 (Bristol Record Office, AC/D/3/10a-b, 11a, 11b & 12), following arbitration between these parties, this petition would seem to be slightly later, from 1422-8 and possibly from 1427.
