Description
Petitioners
Simon de Lausellis.
Name(s)
de Lausellis, Simon
Addressees
King and council.
Nature of request
Simon de Laus[ellis] states that when John de Jargeit, formerly the queen's receiver, acquired the church of Long Newton at the collation of Anthony, formerly Bishop of Durham, and he held it until Lewis, the present bishop, had the barony and temporalities of his bishopric, when he was forced by the ordinance called 'execrabilis' to leave the church, because he held another benefice also. The pope, at the instance of the queen, then gave that benefice to Simon, and he was in peaceful possession until Manser Marmion, the bishop's clerk, obtained a presentation to the church from the king, claiming that he had right of presentation because the church was vacant when the bishopric was in the king's hand after the death of Bishop Richard, and brought a quare impedit against the bishop, which the bishop did not defend, because Manser was his treasurer and his presentee. Simon knew nothing of this until afterwards. Manser then appealed to the court of Rome and sued for protection to the court of York; and during the plea of protection he had himself put in possession of the church and has now brought a prohibition to prevent Simon suing against him, so that he is afraid to defend himself in the plea of protection. He asks that, notwithstanding this prohibition, he might defend himself and pursue his right.
