Nature of request
The inhabitants of the franchise of Durham and Norham state that, after the death of Louis, late Bishop of Durham, when the see was vacant and the temporalities were in the king's hand, the king had an eyre summoned in the franchise, by writ addressed to Ralph de Nevill, keeper of the temporalities, to summon the people of the county of Durham, the county of Sadberge, and the county of Norham, although no eyre was summoned in the county of Northumberland, of which these franchises are part: so it seems to the petitioners that this was done contrary to law and reason, to their disinheritance and to that of their church of Durham. They showed this to the king at Clarendon, but because the king did not have the wise men of his council there, their argument was disallowed, so that they had to make fine with the king in 1000 marks, to avoid their disinheritance and that of their church. They have paid 900 marks of this fine, and the remaining 100 marks are demanded of them. They ask that they might be quit of these 100 marks, because it was made contrary to law and reason, and because they have suffered great destruction in the war, and still incur great expenses because of it. They also ask that no such summons should be made in future, and that their payment of the fine should not be taken as a precedent.
Nature of endorsement
Because it is attested before the council that such a eyre was summoned in the said franchise after the death of Anthony, formerly bishop of the place, whereas no eyre was summoned in the county of Northumberland, and that the people of the same franchise made fine by the same eyre, the remembrances of the Exchequer are to be searched, and what they find is to be sent to Chancery; and the king, when this thing is returned, will be advised until the next parliament.
