Occupation
Prior of St Swithin's, Winchester
Nature of request
The Prior of St Swithin's, Winchester, states that, after the death of William Blundel, who held a messuage and five virgates of land in Avington of him in vileinage, he took this messuage and land into his hand as his vileinage. Much later he was impleaded in the king's court concerning them, although he is ready to aver that they have been held of him and his predecessors in this manner since time immemorial. His adversaries procured John Abel, the Escheator, to take an inquest of office into this. He held this inquest with enemies of his church and the very people who procured him, and without the Prior's knowledge; the inquest found that the Prior had appropriated these lands and tenements contrary to the form of the statute. The Escheator then seized the lands and tenements into the king's hand, and they are still seised, to his great harm. He requests a remedy.
Nature of endorsement
John Abel, lately escheator, is to be ordered to inform the king of the manner and cause of the taking etc. into the king's hand, if the complainant wishes; or he is to have a writ of novel disseisin against the aforesaid John.
