Description (What the record is about)
-
- Petitioners
- Martin Damhoe, citizen of Bayonne.
- Name(s)
- Damhoe, Martin
- Addressees
- King and council.
- Nature of request
- Martin Damhoe states that he was imprisoned in Newgate in London, because of a debt he owed, and that while he was in prison he made an agreement with another prisoner, Gassias de Sauveterre, and Raymond William de Frasshe, his kinsman, that he would give them two-thirds of the land he had bought from Peter Lemosin of Oleron in the Isle of Oleron, in such a way that within the first fifteen days after Gassias was released from prison, he and his kinsman would deliver Martin from prison at their own costs; and the relevant documents were drawn up. But by the force of these documents Raymond William seized the whole of the lands, and neither he nor Gassias ever delivered Martin from prison, and he remained there for sixteen months and more until he was delivered by others. He asks that the Mayor, sheriffs, and coroner of London might be ordered to inquire into the truth of this matter, and to give him letters of testimony. And he asks that the Seneschal of Gascony and the bailli of the Isle d'Oleron might be ordered to seize Gassias and Raymond William and their goods, until Martin has recovered his damages; and that his lands, his charters and all the goods wrongly taken from those lands might be restored to him. And he asks that compensation might be made to the king for the trespass, and that Gassias and Raymond William might be punished.
- Nature of endorsement
- John de Haveringg and Ralph de Sandwyz are to be ordered to inform themselves about the thing; and if they find that it is so, the king is to order the Seneschal of Gascony to take that land into his hand and to do justice to the parties.

Note (Additional information about the record)
- A note at the beginning of SC 8/291, signed R. L. Atkinson and dated 9 March 1932, states, 'Nos 14511-50 and 14551-80 in the next file appear to form an original file, or at any rate a conjunction of some duration. Such as can be dated appear to belong to the year 1305, or thereabouts, so the remainder may provisionally be regarded as belonging to this date'. This petition is therefore given a tentative date of 1305. This would agree with the mention in the endorsement of John de Havering, who was Seneschal of Gascony at the time.
