[c. 1306]
Description
Petitioners
Abbot of Sawley in Craven.
Addressees
King and council.
Occupation
Abbot of Sawley in Craven
Nature of request
The abbot requests that he and his monks are able to be in peace without being aggrieved by the caption until the final resolution of the plea between Osgodby and the abbot and his convent. The abbot had made his appeal to the court of Rome of one sentence definitive given in [...] by a favourable judge and at the suit and procurement of Osgodby, and after the appeal the judge excommunicated the abbot and his monks and they were aggrieved and eventually imprisoned by the sheriff, and the abbot was ordered that he could not summon Osgodby before any judge out of Rome.
Nature of endorsement
Because no complaint is specified they are not able to answer this, but if they are aggrieved unjustly, he should obtain remedy in Chancery. To this that he is able to proceed in his plea notwithstanding the prohibition of the king made to him, because it is to the manifest prejudice of the king if it is pleaded outside of the realm, therefore the king wishes that his prohibition stands and it is not pleaded outside of the realm.
Places mentioned
