Description
Petitioners
Executors of Michael Fitz John of Dunwich.
Addressees
King.
Nature of request
The executors state the Michael Fitz John served in Scotland and Flanders with the king in his wars, and afterwards he was murdered in his bed by unknown people who concealed his death and carried away his goods and chattels; they also state that Fitz John had five manors from the prior of Thetford for a term of years for money that Fitz John paid to the king for debts owed by the prior, and the corn and other goods that were in the manors when he died amounting to £300 were wasted by the prior with the aid of the Earl Marshal, and he will not allow the executors to have the remainder of the term or the goods and chattels; they also state that Fitz Roger and his son owed Fitz John £200 for which they impleaded them before the steward of the king, but they are not able to have the debt without the aid of the king. They request that the king will assess the goods of Fitz John so that the executors are able from the remainder to perform his testament. They also request that Buteturte be assigned to enquire of these matters and do right and determine them according to the law of the land.
Nature of endorsement
Concerning the death they should await the coming of the justices in eyre where felonies are first presented, and then by inquisition before the coroners, or sue elsewhere by writ of appeal of homicide if they wish, and let it be heard. Concerning the goods taken away, they should sue the heirs or executors of those accused. And of the judgment rendered before the steward and marshal they should sue a writ of judgment.
