Nature of request
Cicely and Alice de Dalyle request that a commission enquire into their right in a messuage and land in Barnack and Bainton, of which their brother James was seised until his death. The petitioners were seised of the messuage and land as their brother's heirs until disseised by Wygeton, after whose death Edmund, late Earl of Kent claimed the messuage and lands as part of his manor of Torpel. The petitioners then brought a writ against the earl before the justices of eyre in Northamptonshire, pending which the earl's lands were forfeited to the King, who granted the same messuage and land to Byrford. The land is now in the King's hand again.
Nature of endorsement
Because the land is now in the hand of the Earl of Arundel, they should sue at the common law.
