Date
[c. 1334]
Description
Petitioners
Margaret le Smyth, widow of Richard le Smyth of Minster.
Name(s)
Smyth, Margaret
Addressees
King and Council.
Nature of request
Margaret, widow of Richard le Smyth, requests the resumption of her case against William and Joan Salekyn regarding certain property in Minster on the Isle of Thanet. She states that the case was sued in the court of the Abbot of St Augustine, Canterbury, and was then summoned before the eyre in Kent, but when that eyre was suspended it was returned to King's Bench at three weeks of Easter in the king's eighth year. The record of the eyre was then sent to the Exchequer, for which Margaret sued a writ to return it to the Bench. However, the case now requires another warrant to proceed.
Nature of endorsement
Have a writ to the justices of the Bench to bring process of the case mentioned in this petition and resume the plea and go forward, and do justice to the parties according to the law and customs of the land.
Places mentioned
Minster, [Kent]
Canterbury, [Kent]
Isle of Thanet, [Kent].
People mentioned
Richard le Smyth of Minster, former husband of the petitioner
Abbot of St Augustine, Canterbury
William Salekyn
Joan [Salekyn], wife of William Salekyn
John de Stonore (Stonor), justice
sheriff of Kent.
Note
Dated on the guard to 1332, with reference to CCR 1330-3, p.602, a signification seemingly relating to this case. However, the petition clearly refers to the events of the Kent eyre of 1333-4 (Crook, Records of the General Eyre, p.188), while the reference to Easter in the king's eighth year would indicate a date during or after 1334.
