Description

The affidavits in this series arise from civil actions on the plea side of the Queen's Bench Division of the High Court of Justice and consist of sworn written statements given in evidence.

The bulk of this series dates from 1876 to 1881, but there is one earlier affidavit of 1859 (of the Court of King's Bench) and one later one of 1882.

The eleven bundles also include some affidavits from the Common Pleas and Exchequer Divisions, many consist of answers, sometimes printed, by plaintiffs and defendants to interrogatories, arising from proceedings in actions of damages and debts concerning such matters as breaches of contract, and disputes arising from commercial transactions, contraventions of building leases, etc.

The first eleven bundles (J 5/43-J 5/53) are arranged and numbered under the first letter of the name of the party concerned, and unlike the earlier ones do not appear to have been weeded. Bundles are in no particular order apart from having been boxed according to the year or years to which they relate.

Currently, Queen's Bench Division affidavits are destroyed after 6 or 10 years in accordance with the recommendations of the Denning Report of the Committee on Legal Records (Cmnd 3084) of 1966. The first eleven bundles have not been weeded and appear to have been selected as indicative of the main points at issue, whereas the affidavits in the second block (J 5/54-J 5/97) all relate to 1881 and are mostly in common form, such as affidavits in support of summons and of service of the same.
