[Petition in three parts, damaged and hard to read:]1) Brimmesefeht states that at the last parliament, after Michaelmas in the king's twenty-second year, the king gave him his lands and tenements, but that because of accusations of theft against his wife, he is unable to have delivery of his chattels at the Exchequer. He requests grace of his chattels, as his wife's actions should not bar him.2) He asks that if he cannot have all or part of his chattels by payment of a fine or in some other manner, and asks that the king's ministers might levy the goods from those into whose hand that they have come; and with regard to the remainder, that have come into the hand of his wife, he asks that a term might be granted to him, so that he is not impoverished.3) He requests delivery of his wife who made a pledge for him for which she is imprisoned in the Fleet prison.
Nature of endorsement
. . . agreed in this, that the wife not . . . nor the mainpernors of the wife with regard to . . . nevertheless, those of the Exchequer are to be heard.. . . in this and taught that for this case not . . . unless there is some other underlying cause.Therefore . . . and for a fine of 100 marks that he made he is henceforth to be quit, and to have back all his goods and chattels, taken into the hand of the king etc. provided that he pays the said 100 marks immediately.. . . a wife, in the lifetime of her husband, has obliged herself or her husband in some way and cannot . . .. Therefore the said Gilbert and his wife, and also the wife's mainpernors, on the occasion of the obligation of the wife, the mainpernors and pledges are not obliged . . . the king for the goods and chattels of the said Gilbert. But the Barons of the Exchequer . . . the mainpernors and pledges of the wife for the pledges and mainprise of the goods and chattels . . . be completely exonerated and quit, . . . notwithstanding the obligation made by them to the king. And for the fine or 100 marks that the said Gilbert made to the king, and which he paid immediately, the king has granted to the aforesaid Gilbert that he is to have all his goods and chattels, which on the occasion of the felony of the same Gilbert were seized into the king's hand, in the counties of Westmorland and Lancashire, and elsewhere in the realm, [into whosesoever] hands they have come, so that Gilbert is to have writs to the sheriffs to levy the aforesaid goods and chattels for his use, wherever the said goods etc. until the goods are levied and delivered to him. Thus the said Gilbert is to be released from prison if he is held for this reason and no other. And what was levied of his goods and chattels is to be allowed to him in other debts that he owes the king.
