Nature of request
Margaret requests remedy against Brownfleet concerning lands in Newbald and North Cave. Thomas de Newbald owed £60 by statute merchant to Hotham who gave it to Burghes who gave it to Margaret and the executors of his will. After her husband's death Margaret married Rote and together they pursued the statute in Lillesdon's name at London before Metam, Resceby, Ardern, Resceby and others, agreeing to pay Lillesdon 4 marks, and they were extended a messuage and bovate in Newbald and meadow in North Cave of Newbald's lands for 47 years in full payment of the £60. Brownfleet then purchased these lands from Rote and Margaret for the said term with all the right that Waldeby had or should have in them (as next heir to the lands as was found by inquisition taken at Newbald) and from whom Rote and Margaret purchased a release of the lands for 10 marks to Brownfleet's use. Brownfleet should have paid them 80 marks for this land, and was bound to do so by an obligation of 100 marks, but he only paid 39 marks, paying 25 marks in their name to Lillesdon, who should only have received the said 4 marks. Because the residue was still due to them, they were all granted a day at St Martin-le-Grand on Friday before Martinmas in the 9th year of Richard II [1385], on which day Brownfleet caused Rote and Margaret to be imprisoned at Newgate on a false charge, causing William, for fear of death, to surrender the obligation and a release made thereon, because of which imprisonment Rote died soon after. She also makes further complaints against Brownfleet involving lands in Newbald.1)
Nature of endorsement
Brownfleet should be summoned by writ to be before the council on a day to be named by the chancellor, and when the parties have been heard, full justice will be done.2) Because Brownfleet did not pay Rote and Margaret, Rote sued writs until outlawed, to his great damage.
