John and Alice Weston request that whereas they brought a writ of assize of novel disseisin before Rickhill and Cassy at Winchester on Monday before Mary Magdalene in the 12th year of the King's reign [1388] against Upton concerning their free tenement in Warblington, on which day Upton did not appear but Hervy answered that Upton had been outlawed at Stevens's suit in Sussex, because of which the said tenements were seized into the King's hand, because of which the justices would not take the assize, that a writ be directed to the justices to proceed with taking the assize.
