Nature of request
John Cherlton states that he had a ship, the 'Mary' of Plymouth, fully loaded with wines and other merchandise in the port of Plymouth, and that Stephen Derneforde the elder maliciously brought plaints of debt in the courts of the Admiralty and the Watercourt against him, John Horewode, John Blakeston and others, and that by maintenance and collusion of William Bentele, Henry Crese and John Sampson the younger he had the ship and its contents seized on the Tuesday before the feast of the Ascension last, and is still under arrest, in order to extort from John a false custom paid to the bailiffs of the court for the non-suit of his adversaries; and he cannot have delivery of his ship by the law of the land, unless he pays this custom. He requests writs to John Horewode, John Blakeston, William Bentele, Henry Crese and John Sampson, to appear before the King's council to answer to him for this trespass and arrest, and to deliver his ship and goods to him, on sufficient security that he will answer to anyone wishing to complain against him.
