Description

William le Clerk of Kyme by Old Sleaford.

Nature of request
William le Clerk states that because there was an error in the record and process of a plea of trespass that William de Banham sued against him before Robert Darcy and William de la Launde, appointed to hear and determine that trespass, he sued to these justices to have the record and process brought before the King. But they have continually delayed, Robert saying that he is a man of arms and cannot answer without William, who is a man of law, and William saying that Robert is the principal justice and he cannot answer without him. And in the meantime William de Banham has recovered his damages from William le Clerk's goods, but nevertheless William le Clerk is still in prison in Lincoln. He requests a remedy.
Nature of endorsement
With regard to the first point, he is to have a writ to the Sheriff to attach the principal justice to appear before the King to answer for the contempt, which writ ought to contain the allegation. With regard to the second point, he is to have a writ to the justices if the process is such that they may receive one.
