Description
Petitioners
Commons of Parliament.
Addressees
King and lords of Parliament.
Nature of request
The commons complain that when writs have been directed to sheriffs to arrest various people, the sheriffs have taken money from the parties so sued for their bail, and have also taken money for embezzling writs, and when they have had writs to empanel people for inquests and to return and certify this into the King's Court, they return and certify various men's names without warning the men. They request that every sheriff return his writs into the King's Court on the days they are returnable, that he take sufficient surety that people arrested will keep their day in the King's Court, and that he warns in reasonable time any person empanelled for inquests in the King's Court. They also request that if any sheriff does not do this, the aggrieved party may sue against him in the Exchequer or in any of the King's Courts, and if the sheriff is convicted the aggrieved party should have double damages. By virtue of the King's writs sheriffs may still arrest people for debt or damages recovered, felony and treason. And that justices of the peace and stewards of leets and hundreds may have power to enquire into such misdeeds of sheriffs and certify the inquiry before the justice of deliverance. And that this ordinance shall endure until the next Parliament.
