Date
[c. 1273]
Description
Petitioners
Township of Fawsley.
Addressees
King and council.
Nature of request
The township of Fawsley requests:1) justice because they have had seisin of the common of a pasture in Badby Wood since the time of Henry III, when Capes was keeper of Fawsley until he sold his right in the pasture to the abbot and convent of Evesham, and the people have often sued to recover their right of common but have been delayed by the abbot for over twenty years, and so cannot levy the King's farm;2) that whereas they gave Martinaus 5 marks for his aid with their inquisition, but he neither helped them nor returned the money, that an inquisition be taken in this matter and that the money be returned to them by his executors, as he is dead.
Nature of endorsement
[None].
Places mentioned
Fawsley, [Northamptonshire]
Badby wood, [Northamptonshire]
Evesham, [Worcestershire].
People mentioned
Henry [III], King of England
Hugh de Capes, keeper of Fawsley
Abbot and convent of Evesham
Enketin de Martinaus.
Note
No date on the guard. The petitioners held the common in question of the gift of the late Henry III (1216-72) until Hugh de Capes (d. 1256) gave it to Evesham Abbey. This must therefore have occurred before 1256. The petitioners have been trying to recover their right for over twenty years, so this petition must date to near the beginning of Edward I's reign.
