Nature of request
The burgesses and community of Kingston upon Hull request that:1) whereas soon after its foundation the town was almost destroyed because of arrests made there on alien merchants, which arrests were then forbidden by letters patent of the King's father, that henceforward no alien merchant be arrested in the town or in the Humber on his arrival, stay or departure from the said town for a debt for which he is not a pledge or the principal debtor or for a trespass which he did not commit;2) whereas it is contained in their charters that they should have all the franchises and free customs belonging to a free borough, by virtue of which the bailiffs of the town have held pleas of assize of fresh force and of debt where the sum exceeds 40s without writ and other pleas, that the general words in their charters be declared by particular words concerning the named pleas, and that after recovery by assize of fresh force they can have cognisance of any re-disseisin by writ of Chancery; 3) whereas it is contained in their charter that they cannot implead or be impleaded elsewhere, which franchise has sometimes been contravened, that this point be clarified in the following words: 'Likewise that women covered by their husbands may have cognisance and pronounce their right to tenements in the borough before the mayor, bailiffs and at least 12 burgesses in full court.' 1)
Nature of endorsement
On the first point the King has granted that all such arrests should be suspended, and when arrests are ordered they should be made so that no damage be done to the town.2) On the second point it seems to the council that because the mayor, bailiffs and keeper can hold such pleas of assizes, that this should be granted, and also the third point.
