Nature of request
Robert and Ella le Fitz Payn request that whereas Burnel sued a writ of scire facias against them of lands and tenements in Surrey returnable before the King on the quinzaine of St Martin in the 19th year of Edward II [1325], on which day the sheriff witnessed that he had warned the petitioners, when they were not warned, by which testimony they lost their lands, and they sued a writ to le Scrope and his companions to cause the warners, the sheriff and the party who had recovery to come before them on the quinzaine of St Hilary last, on which day the warners came and were examined, that justice be done to them according to the findings of this examination, because le Scrope and his companions will not do anything without the advice of the council.

It was agreed that a writ of deceit should be maintained, and should be valid in case of warning or warning was given as well as in case of summons or summons was given.
