SC 8/263/13115
Date
[c. 1377]
Description
Petitioners
Not specified.
Addressees
King and council.
Nature of request
A request that two or three proctors be chosen to sue against the King of France so that the second and third articles of an agreement made between the Kings of England and France in 1303 be well kept and everything done to the contrary redressed, especially the recent arrests made by the court of France of the bodies and goods of the people of Southampton and aliens of England and other lands of the King's lordship found outside holy places in France or in lands of the King of France's jurisdiction until satisfaction is made to la Causade and other French subjects for their damages at the hands of English subjects. They also request that the seneschal of Gascony not be distrained to make execution of such arrests contrary to the ancient rights and franchises of the King, nor made to enter process of excess and disobedience in the court of France because the appeals of the English people pending in the court of France on such damages done in England or elsewhere in the King's lordship should not be determined in that court, as formerly happened when the merchants and mariners of England heading to Rouen and other places where the arrests were made were further damaged by having to pay 6d on the pound for all their merchandises.
Nature of endorsement
[On face] For the King, the seneschal of Gascony and the community of his subjects.[On dorse] Item, men of the King's council should be assigned to examine the requests and answers made to the King of France by the proctors of the King's grandfather, his proctors and those of his subjects, so that the King of France can be put in default of Boniface VIII's pronouncement and of covenants of peace, truces and agreements made between the Kings of France and England, to examine the material proclaimed to Boniface and Clement, to purchase bulls of monition and others of rigour and duress to be sent to the King of France, and to inform the said proctors of the said requests and answers.Item, that the clerk assigned to the office of Martel, intending to defend the rights of the King's grandfather, made the said fines.

Note
Dated on the guard to c. 1377, since reference is made to the King's grandfather and the petition probably dates to early in Richard II's reign. 'Pope Clement' is evidently either Clement V or Clement VI.
