Nature of request
John de Eland states that he claimed certain tenements in Hipperholme against John de Warenne, Earl of Surrey, which the Earl claims to hold of the grant of Edward I for term of life, as part of the manor of Sowerbyshire, with the reversion to the King: so that he cannot answer to John without the King. The justices refuse to proceed without consulting the King, so John asks for a writ ordering them to proceed.
Nature of endorsement
The justices of the Bench are to be ordered, by a writ containing the effect of this petition, that if the process is such as the petition claims, they are to proceed in the plea, doing justice to the parties notwithstanding the Earl's allegation, provided that they do not proceed to render judgment without consulting the King.
