Description

3 individual petitions (the prisoner and James Milnes & Co [x2]) and 3 collective petitions (Margaret Auchinuide[?] the prisoner's wife and 2 elders; 51 people, of Port Dundas, merchants operating on the Forth of Clyde canal, Stirling and Dumbartonshire [many addresses given] and 79 people ship-owners and merchant in the Grangemouth area, Stirling) on behalf of James Sinclair, tracker and hauler, convicted at the Circuit Court of Justiciary held at Stirling on 28 April 1827 for the theft of grain from Messrs James Milne & Co in the warehouse of Messrs. Pollock, Gilmour and Co. There is an affidavit from the prisoner; a list of the witnesses; statements from R Young, warehouse keeper, Alexander McLucky and Peter Wilkie, agent; a copy of correspondence between Marquis of Landsdowne and Robert Peel; letters from Robert Ward MP [x4], John Sinclair and Sir Robert Peel, stating that the case would be reviewed half way through the prisoner's sentence. Grounds for clemency: the prisoner has a wife and 8 children to support who will become a burden on the county, of previous good character, known to be a 'simple silly man' and the prisoner purchased the grain in good faith from the warehouse supervisor in the belief that he was authorised to sell small quantities of sweepings of wheat grains. Initial sentence: 7 years transportation. AN 8. [Scot]
