Nature of request
Walter de Suttone and Joan his wife state that they brought an assize of novel disseisin against the Bishop of Bath and Wells concerning their rights of common pasture in Cheddar, belonging to their free tenement of Alston Sutton. The Bishop counter-claimed that the moor where the pasture was claimed belonged to his manor of Cheddar, and was granted to Jocelin his predecessor by Henry III, and also granted that the bishop and his successors would not be impleaded concerning the manor or its appurtenances except in the presence of the King or his heirs; and he requested judgment if he ought to answer to the assize. Walter and Joan answered that they were seised of the rights of common long before the grant, and afterwards, and wished to aver this by assize. But because of the Bishop's claim the justices have stayed proceedings, to the harm and disinheritance of Walter and Joan. And in the meantime the Bishop has purchased a writ of oyer et terminer before William de Bourne, who is a canon of Wells and John de Erlee, who wears the Bishop's robes. They request a remedy.
Nature of endorsement
And the Bishop appeared and produced the charter of King Henry, grandfather of the present King, before the council, in which was contained 'It is also prohibited that the aforesaid Hugh, or his heirs, or those to whom he has granted the aforesaid manors in inheritance, be put in pleas concerning the aforesaid manors, or anything which pertains to them, unless in our presence or that of our heirs. We will warrant the barony to them against all living persons.' And therefore before the King.

Dated to c. 1321 with reference to SC 8/142/7098, which is datable to c. 1321. This might be a copy of the earlier petition mentioned there, but it does not have the endorsement mentioned in SC 8/142/7098. It must be from before 1323, as William de Bourne, prebendary of Wells, died before 23 December 1323 (Fasti Ecclesiae Anglicanae, vol. VIII, p.82).
