Reference
SC 8/259/12925
Date
[? c. 1328]
Description
Petitioners
Matthew Fitz Herbert.
Name(s)
Fitz Herbert, Matthew
Addressees
King and council.
Nature of request
[This petition is nearly illegible.]Matthew Fitz Herbert makes two petitions:1) He states that he claims two thirds of the manor of Leckhampstead against Robert de Sapy, but that Robert says that he received them of the gift of Piers de Gavaston, Earl of Cornwall, with reversion to Piers' heirs; so that he cannot proceed without the King. Matthew requests a writ to the justices to proceed.2) He also states that he claims the third part of this manor against Eleanor, widow of Herbert Fitz John. Again it is claimed that this was a gift from Piers de Gavaston, Earl of Cornwall, so again she cannot answer without the King. Again Matthew request a writ to the justices to proceed.
Nature of endorsement
He is to have a writ to the justices to go ahead in the process and to do justice to the parties, provided that they do not proceed to judgment without consulting the King.
Places mentioned
Leckhampstead, Berkshire.
People mentioned
Robert de Sapy
Piers de Gavaston (Gaveston), Earl of Cornwall
Eleanor [Fitz John], widow of Herbert Fitz John
Herbert Fitz John.
Note
Tentatively dated to c. 1328 with reference to SC 8/54/2680, which is clearly datable to 1328. This petition would seem to be later, as Eleanor Fitz John is now in possession of lands she was claiming in SC 8/54/2680.
