Nature of request
Writ of Edward III to the sheriff of Sussex, ordering him to instruct the Abbot of Fecamp to appear before he King in the Chancery three weeks after Easter to show any reason he has why execution should not be made on his goods and chattels, and those of his men and merchants, for the losses incurred by John de Barton and his companions, merchants, when the Abbot's man Roger Furmertyn robbed them, and further to do and receive what the court adjudges.
Nature of endorsement
I informed the Abbot of Fecamp in his manor of Steyning, to appear on the day and at the place names in this writ, by Richard le Palmere, John Herberd. By Nicholas Gentil, Sheriff.[Deleted] And afterwards, with the assent of the parties, a day was given to the same parties in Chancery one month after Michaelmas next.John de Barton puts in his place David de Wollore and William de Wellum, alternatively, his attorneys to sue for execution of a certain arrest against the Abbot of Fecamp for £280, as the writ requires.On which day the aforesaid John came for himself and his companions and appeared against the Abbot and requested execution of the writ etc. And the aforesaid Abbot came likewise by his attorney etc. and with the assent of the parties a day was given to the same parties in Chancery on the morrow of the Ascension of the Lord next, wherever etc. On which day both the aforesaid John for himself and his companions and the aforesaid Abbot by his attorney came, and the aforesaid John for himself and his companions requested as before etc., and with the assent of the parties a day was given to the same parties in Chancery one month after Michaelmas next wherever etc. On which day both the aforesaid John in person for himself and his companions and the aforesaid Abbot by James de Kyngeston his attorney came to Chancery at Lenton and the aforesaid John requested execution of the arrest, both against the goods and chattels of the Abbot and against those of his men and merchants of his demesne, power and jurisdiction according to the tenor of the writ etc. And the Abbot gave no reason why execution should not be made against his goods and chattels and those of his men and merchants, because of which it is decided that execution should be made both against the goods and chattels of the Abbot and against those of his men and merchants. And he is to have a writ on this.
